BACKGROUND <br /> To begin the process of renewing the Tri- Valley Tourism Business Improvement District <br /> (TVTBID), on April 20, 2010, the City of Pleasanton adopted a Resolution Requesting <br /> Consent from the Cities of Dublin, Livermore and San Ramon, and the Town of <br /> Danville, to renew the existing TVTBID with the inclusion of the Town of Danville. <br /> Concurrently, the City of Pleasanton adopted a Resolution of Intention to renew the <br /> business improvement district. The Councils of the Cities of Dublin, Livermore and San <br /> Ramon, and the Town of Danville have each adopted Resolutions Granting Consent to <br /> the City of Pleasanton to renew the district. Additionally, the Town of Danville adopted a <br /> Resolution to Intention to Modify its Management District Plan to allow merging of the <br /> two districts. <br /> As follow up to individual and group outreach efforts by CVB staff, all 37 eligible lodging <br /> businesses proposed to be included in the renewed district were sent notice of the June <br /> 1 public hearing; no majority (50 protest was received. As such, on June 1, 2010, the <br /> City of Pleasanton introduced an ordinance to formalize the renewal of the TVTBID as <br /> proposed and authorized the City Manager to enter into an agreement between the Tri <br /> Valley Convention Visitors Bureau (CVB) and the City of Pleasanton to administer the <br /> district. <br /> Pleasanton will continue to serve as the lead agency in renewing the district and <br /> administering assessments, while each city will remain responsible for collecting the <br /> assessments from the lodging businesses in that city. As is done currently, the cities will <br /> transmit the funds to Pleasanton which, in turn, forwards the funds to the CVB. For <br /> administering the district on behalf of the CVB, the City of Pleasanton will receive an <br /> administrative fee of up to 1% of the TVTBID's estimated budget, or $15,200 each year, <br /> as well as its prorated share of the 1% BID collection fee, about $5,775 each year. <br /> DISCUSSION <br /> As there was no majority protest (50 noted prior to or at the first reading of the <br /> ordinance renewing the TVTBID, the City Council is being asked to approve the attached <br /> Resolution Modifying the Management District Plan of the Tri Valley Tourism Business <br /> Improvement District. This modification of the Management District Plan will shorten the <br /> duration of the existing TVTBID, from five years to four years and five months, causing <br /> the TVTBID to expire on July 15, 2010. This then allows the renewed TVTBID and <br /> accompanying Management District Plan to go into effect on July 15, 2010. <br /> The Resolution Modifying the Management District Plan is in agreement with both the <br /> introduced Ordinance No. 2004 and the City's agreement with the CVB. The life of the <br /> renewed district will be five years, after which the district would need to be considered <br /> for renewal. <br /> Page 2 of 3 <br />
