Staff, therefore, <br />believes that the Mitigated Negative Declaration can be issued in conformance with CEQA <br />standards. If the Planning Commission concurs with this environmental assessment, it <br />must make the finding that the Mitigated Negative Declaration is appropriate prior to <br />recommending approval of the proposed project. <br />State Clearinghouse Review <br />The California Department of Fish and Game (CDFG) and the Regional Water Quality <br />Control Board (RWQCB) as well as the United States Army Corps of Engineers (SACE) <br />and the United States Fish and Wildlife Service (USFWS) are Responsible Agencies for <br />this proposal. Where California State agencies are responsible agencies, CEQA <br />mandates a 30 -day review period by the State Clearinghouse (SCH) of the Office of <br />Planning and Research (OPR) and for any organization that may have previously <br />commented on the IS /MND: the California Audubon Society (CAS), California Native Plant <br />Society (CNPS), and the California Oaks Foundation (COF). The IS /MND and Notice of <br />Completion (NOC) was sent to the SCH on March 24, 2010 and is tentatively scheduled to <br />end on April 26, 2010. <br />Staff notes that the IS /MND and the NOC with the project's plans and environmental <br />reports were referred to the RWQCB, the CDFG, and the United States Fish and Wildlife <br />Service directly after the SCH referral of the IS /MND.
