RESOLUTION NO. 10- <br />ATTACHMENT 3 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON, <br />APPROVING A MITIGATED NEGATIVE DECLARATION FOR THE <br />APPLICATION OF DR. WILLIAM AND LYDIA YEE, AS FILED UNDER <br />CASE PUD- 87- 19 -03M <br />WHEREAS, at its meeting of June 1, 2010, the City Council received a proposed <br />Mitigated Negative Declaration for the application of Dr. William and Lydia Yee for a <br />Planned Unit Development major modification to modify the approved development plan <br />for their property located at 4100 Foothill Road to allow four custom lots on an <br />approximately 29.8 -acre site, design guidelines, and off -site street construction on Foothill <br />Road; and <br />WHEREAS, the City Council received and reviewed the Initial Study, dated <br />March 29, 2010, Mitigated Negative Declaration, and related documents, and received <br />the recommendations of the staff, the Planning Commission; and <br />WHEREAS, a duly noticed public hearing was held on June 1, 2010, at which <br />time the public was given the opportunity to comment on the environmental impacts of <br />the proposed project, and where the City Council received written comments from other <br />organizations and interested persons; and <br />WHEREAS, the City Council has reviewed the potential impacts of the proposed <br />project in accordance with the applicable state and local laws and guidelines governing <br />the preparation of Mitigated Negative Declarations; and <br />WHEREAS, the City Council finds that the proposed project would not have any <br />significant adverse effects on the environment. <br />NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF <br />PLEASANTON DOES RESOLVE, DECLARE, DETERMINE, AND ORDER THE <br />FOLLOWING: <br />SECTION 1. Approves the Mitigated Negative Declaration for the application of Dr. <br />William and Lydia Yee for a Planned Unit Development major modification (PUD- 87 -19- <br />03M) to modify the approved development plan for their property located at 4100 Foothill <br />Road to allow four custom lots on an approximately 29.8 -acre site, design guidelines, and <br />off -site street construction on Foothill Road. <br />SECTION 2. The City staff is directed to cause a Notice of Determination to be <br />filed pursuant to Section 5.4(g) of Resolution No. 77 -66. <br />SECTION 3. This resolution shall become effective immediately upon its <br />passage and adoption. <br />1 <br />
