Parcel Map <br />c. The property owner or the MA shall ensure that all wastewater from vehicle and <br />equipment washing operations is not discharged to the storm drain system. <br />d. The CC &Rs covering Lots 1 through 4 shall include the statement, "No person <br />shall dispose of, nor permit the disposal, directly or indirectly, of vehicle fluids, <br />hazardous materials or rinse water from cleaning tools, equipment or parts into the <br />private, on -site storm drains. <br />e. The CC &Rs covering Lots 1 through 4 shall include the statement, "All private on- <br />site storm drains shall be cleaned by the property owner at least twice a year with <br />one cleaning immediately prior to the rainy season." <br />f. The vegetated bio- retention swales on Lots 1 through 4 shall be mowed and the <br />clippings removed on a regular basis by the Property Owner. <br />The CC &Rs and the design guidelines covering Lots 1 through 4 shall include the above <br />statements in their wording. <br />92. With the parcel map, the applicant shall set forth the maintenance areas and <br />responsibilities of the proposed development. The applicant shall record CC &R's at the <br />time of recordation of the parcel map, which shall create a Maintenance Association <br />(MA) for the development. The CC &R's shall be subject to the review and approval of <br />the City Attorney prior to recordation of the parcel map. The MA shall be responsible for <br />the maintenance of all private streets, storm drain system, utilities, wildland fire and <br />buffer areas, and other common areas /facilities on the site. The City shall be granted <br />the rights and remedies of the association, but not the obligation, to enforce the <br />maintenance responsibilities of the property owners association. <br />93. The applicant shall show the building envelopes on a reference sheet to the parcel map. <br />This reference sheet shall be recorded with the parcel map. <br />94. The recorded deed of sale for all lots covered by this PUD Development Plan approval <br />shall include the following: <br />The following statement, signed by the future homeowner, stating that, "You are <br />hereby advised that this property is surrounded by land zoned and /or used for the <br />day and night -time activity relating to livestock grazing and the keeping of livestock. <br />Some of the impacts associated with this use include, but are not limited to, noise, <br />odor, dust, chemicals, refuse, waste, unsightliness, use of agricultural equipment, <br />and traffic. Permitted agricultural pursuits conducted in accordance with good <br />practice and maintenance is not deemed by the City of Pleasanton to be a <br />nuisance." <br />Wording for this disclosure shall be submitted to the City Attorney for review and <br />approval before approval of the parcel map for this development and shall be recorded <br />over the project site by separate instrument. <br />95. With recordation of the parcel map, the applicant shall abandon all access rights to <br />Foothill Road to the City of Pleasanton. <br />24 <br />
