BACKGROUND <br /> Proposal <br /> The applicants Dr. William and Lydia Yee request a PUD development plan <br /> modification for a four -lot development on a 29.8 -acre site located on the west side of <br /> Foothill Road. The homes will be located in designated building envelope areas with the <br /> remaining lot area preserved as permanent open space in private ownership. Design <br /> guidelines will control the building and landscape designs. Separate design review <br /> approvals will be required for the individual lots. <br /> Previous Planning Commission Hearing, Six -Lot Proposal <br /> On August 13, 2008, the Planning Commission reviewed the applicants' proposal for a <br /> six -lot development plan and recommended its approval. The Commission conditioned <br /> the proposal to install a six -foot wide bicycle lane in the Foothill Road right -of -way along <br /> the site's entire Foothill Road frontage, a distance of approximately 1,200 feet from the <br /> northernmost project boundary to the realigned entrance; to allow a vineyard on the lot <br /> adjoining Foothill Road with a conditional use permit; to allow non habitable accessory <br /> structures such as barns and sheds in the open space areas of the six lots with a <br /> conditional use permit; to require a minimum LEED rating of 100 points for the homes; <br /> and to conform the building height on these lots to the West Foothill Road Corridor <br /> Overlay District 30 feet measured from the buildings' lowest to highest point. <br /> After the Planning Commission hearing, staff received comments from responsible <br /> agencies and concerned groups regarding the environmental review. Their issues <br /> included the accuracy of the analyses prepared by the applicant's consultants; the loss of <br /> oak woodland on the site and along Foothill Road in the most visible area of the site to <br /> residents living nearby and traveling on Foothill Road as well as the biological impacts of <br /> such loss; and the impacts resulting from a channel adjoining Foothill Road resulting from <br /> the street widening required to construct a continuous bicycle lane on the entire project <br /> Foothill Road frontage. This is an open channel in a relatively natural state under the <br /> jurisdictions of the Army Corps of Engineers, the California Department of Fish and <br /> Game, and the Regional Water Quality Control Board, and, potentially, the United States <br /> Fish and Wildlife Service. Filling the channel required new channel and the construction <br /> of the new channel required significant grading resulting in the loss of the entire oak <br /> woodland area in this stretch of Foothill Road. Staff believed that these comments <br /> should be addressed before the City Council review. <br /> Four -Lot Proposal <br /> The revised four -lot development plan reduced the project from six lots to four lots; <br /> reduced the area of the building envelopes; reduced the number of impacted trees from <br /> 248 trees to 67 trees; and deleted the road widening for the bicycle lane into the creek <br /> channel that, in turn, reduced grading and tree removal. The applicant's consultants <br /> replied to the agency and public comments and the consultants' reports were peer <br /> reviewed and updated with new information. The revised development plan, IS /MND, <br /> and supporting materials was sent to the State Clearinghouse and directly to all <br /> concerned parties. The State Clearinghouse review was completed on April 21, 2010. <br /> Page 1 of 16 <br />
