RESOLUTION NO. 10 -359 <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON, <br /> APPROVING THE AFFORDABLE HOUSING AGREEMENT BETWEEN THE CITY OF <br /> PLEASANTON AND CIVIC SQUARE, LLC, REGARDING THE CIVIC SQUARE <br /> APARTMENTS EXPANSION PROJECT <br /> WHEREAS, Ordinance No.1488 of the City of Pleasanton sets forth a Lower Income <br /> Housing Fee requirement to support an affordable housing program (at Chapter 17.40 of the <br /> Pleasanton Municipal Code) which authorizes the City to enter into regulatory agreements with <br /> developers to exempt projects from the lower- income housing fee if a project provides fifteen <br /> percent (15 of its residential units at affordable levels; and <br /> WHEREAS, Civic Square, LLC has made an application to the City for an Affordable <br /> Housing Agreement for the Civic Square Apartments expansion project; and <br /> WHEREAS, the Civic Square Apartments expansion project is categorically exempt from <br /> the requirements of the Califomia Environmental Quality Act (CEQA), Section 15332, In -Fill <br /> Development Projects, Article 19; and <br /> WHEREAS, a duly noticed public hearing concerning the Affordable Housing Agreement <br /> was held by the City Council on April 20, 2010; and <br /> WHEREAS, the City Council considered all the information presented at the public <br /> hearing by Civic Square, LLC, staff, and members of the public regarding the terms of the <br /> Affordable Housing Agreement. <br /> NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF <br /> PLEASANTON DOES RESOLVE, DECLARE, DETERMINE, AND ORDER THE FOLLOWING: <br /> SECTION 1. Finds that the proposed Affordable Housing Agreement between the City <br /> of Pleasanton and Civic Square, LLC, is consistent with the City's General Plan and the <br /> objectives of the Lower Income Housing Fee ordinance and the City's affordable housing <br /> policies. <br /> SECTION 2. Approves the Affordable Housing Agreement between the City of <br /> Pleasanton and Civic Square, LLC, a copy of which is attached hereto as Exhibit C and <br /> incorporated herein by this reference; and authorizes the City Manager to execute the <br /> Affordable Housing Agreement. <br /> SECTION 3. This resolution shall become effective immediately upon its passage and <br /> adoption. <br /> PASSED, APPROVED, AND ADOPTED by the City Council of the City of Pleasanton at <br /> a regular meeting held on April 20, 2010. <br /> 1 <br />
