RESOLUTION NO. 09 -320 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON AMENDING THE MASTER FEE SCHEDULE RELATED TO PARKING CITATION PENALTIES WHEREAS, California Vehicle Code section 40203.5 authorizes the City Council to establish a schedule of penalties and late payment penalties for parking violations of the California Vehicle Code and Pleasanton Municipal Code; and WHEREAS, California Vehicle Code section 40203.5 provides that to the extent possible, issuing agencies in the same county shall standardize parking penalties; and WHEREAS, on May 19, 1992, the City Council adopted the Master Fee Schedule, Resolution No. 92 -100; and WHEREAS, on June 1, 1993, the City Council amended the Master Fee Schedule by adopting Resolution 93 -68 to establish penalties for parking violations; and WHEREAS, during 2008, the California State Legislature enacted Senate Bill 1407 to provide for enhanced revenues to finance immediate and critical needs construction and renovation projects of court facilities throughout the State; and WHEREAS, as a result of SB 1407, the amount per parking citation collected that the City of Pleasanton must pay to the County of Alameda to finance state courthouse construction and criminal justice facilities increased from $5.00 to $9.50 per parking citation; and WHEREAS, since 1993, the penalties for parking violations have not been revised; and WHEREAS, the City wishes to increase current parking penalties to recover the increased state mandated penalties and, in most cases, keep the penalties consistent with those assessed by other cities throughout Alameda County; and WHEREAS, the City also wishes to add to the Master Fee Schedule additional parking violations that are not currently included; and NOW, THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: SECTION 1: The Master Fee Resolution No. 92 -100, Section V, Police Department, Sub section E, Parking Penalties is hereby amended to read as set forth in the attached Attachment "A SECTION 2. The City Council directs that the Master Fee Schedule shall be amended to reflect these new penalties and fees effective immediately. SECTION 3. The City Clerk shall certify the passage of this resolution and enter it into the book of original resolutions.
