RESOLUTION NO. 10 -355 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON INITIATING FORMATION OF UNDERGROUND UTILITY DISTRICT NO. 09 -01, OLD STANLEY BOULEVARD FROM FIRST STREET TO SANTA RITA ROAD, AND SETTING A PUBLIC HEARING WHEREAS, Chapter 13.12 of the Pleasanton Municipal Code establishes a procedure for the creation of underground utility districts and requires as the initial step in such procedure the holding of a public hearing to ascertain whether the public necessity, health, safety or welfare requires the removal of poles, overhead wires and associated overhead structures and the undergrounding of wires and facilities for supplying electric, communication, or similar or associated service in any such district; and WHEREAS, it has been recommended that such an underground utility district, hereinafter called District, be formed on Old Stanley Boulevard from First Street to Santa Rita Road. NOW, THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: Section 1: A public hearing, as may be continued from time to time, will be held by the City Council on June 15, 2010, at the hour of 7:00 p.m. in the Council Chambers, 200 Old Bernal Avenue, Pleasanton, California, to ascertain whether the public necessity, health, safety or welfare requires the removal of poles, overhead wires and associated overhead structures and the underground installation of wires and facilities for supplying electric, communication or similar or associated service in the District herein above described. Section 2: At such hearing all persons interested shall be given the opportunity to be heard. Section 3: The City Clerk shall notify all affected property owners as shown on the last equalized assessment roll and utilities concerned of the time and place of such hearing by mailing a copy of this resolution to such property owners and utilities concerned at least ten (10) days prior to the date thereof. Section 4: The area proposed to be included in the District is shown upon that certain map entitled Underground Utility District No. 09 -01, which is on file in the office of the City Engineer of the City of Pleasanton. Section 5: This resolution shall become effective immediately upon its passage and adoption. PASSED, APPROVED AND ADOPTED by the City Council of the City of Pleasanton at a regular meeting held on May 4, 2010.
