the project developer submits a signed statement acknowledging that the plan check <br /> fees may be forfeited in the event that the approval is overturned on appeal, or that the <br /> design is significantly changed as a result of the appeal. In no case will a building permit <br /> be allowed to be issued before the effective date. <br /> 35. The applicant shall submit two copies of the site soils report to the Building and Safety <br /> Division for review before the issuance of a grading permit. <br /> 36. The structures covered by this approval shall be constructed to meet Title 24 state energy <br /> requirements, and to comply with all codes and ordinances in effect before the Building <br /> and Safety Division will issue permits. <br /> 37. All HVAC condensing units shall be located on the plans. <br /> 38. Prior to final building permit inspection and occupancy, a final inspection and approval by <br /> the Planning Division is required in order to confirm that all conditions of approval prior to <br /> occupancy have been satisfied. <br /> Landscaping and Irrigation System Design and Operation <br /> 39. No trees shall be removed other than those specifically designated for removal on the <br /> approved plans or tree report. Prior to issuance of a grading or building permit, the <br /> applicant shall install a temporary six -foot tall chain -link fence along the existing tree drip <br /> lines as shown on the plans. The fencing shall remain in place until final landscape <br /> inspection by the Planning Division; removal of such fencing prior to that time may result <br /> in a "stop work" order. Failure to comply with the following requirements may also result <br /> in a "stop work" order. <br /> 40. The following statements shall be printed onto the site, grading, and landscape plans <br /> where applicable to the satisfaction of the Planning Division prior to the issuance of a <br /> building permit: <br /> No existing tree may be trimmed or pruned without prior approval by the Director of <br /> Community Development. <br /> No equipment may be stored within or beneath the drip lines of the existing trees. <br /> No oil, gasoline, chemicals, or other harmful materials shall be deposited or disposed <br /> within the drip line of the trees or in drainage channels, swales, or areas that may <br /> lead to the drip line. <br /> No stockpiling /storage of fill, etc., shall take place underneath or within 5' of the drip <br /> line of the existing trees. <br /> 41. All trees used in landscaping shall be a minimum of 15- gallons in size and all shrubs <br /> shall be a minimum of five gallons in size, unless otherwise shown on the approved <br /> landscape plan or otherwise conditioned by this approval. Drought tolerant species shall <br /> be used, verified by the City's Landscape Architect, and shall be watered with a drip <br /> irrigation system. <br /> 42. A final landscape plan and irrigation plan shall be submitted to and approved by <br /> Planning Division as part of the building permit plan set prior to issuance of an on -site <br /> 6 <br />
