CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> AL~DA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 1129 <br /> <br /> AN ORDINANCE A~NDING TITLE V, CHAPTER5, ARTICLE <br /> 1 OF THE ORDINANCE CODE OF THE CITY OF PLEASANTON <br /> TO REQUIRE TRUCKS TO USE DESIGNATED HAUL ROUTES <br /> <br />THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN <br />AS FOLLOWS: <br />Section 1: Title V, Chapter 5, Article 1, Section 5-5.03(A) is amended in its entirety to read as follows: <br /> <br /> "§ 5-5.03 Exceptions. <br /> <br /> A. Pickups and Deliveries. This article shall not <br /> prohibit any commercial vehicles coming from an <br /> unrestricted street having ingress and egress <br /> by direct route to and from a restricted street <br /> when necessary for the purpose of making pickups <br /> or deliveries of goods, wares and merchandise <br /> from or to any building or structure located <br /> on the restricted street or for the DurDose of <br /> delivering materials to be used in the actual <br /> and bona fide repair, alteration, remodeling <br /> or construction Of any building or structure upon <br /> the restricted street for which a building permit <br /> has previously been obtained. As used herein <br /> direct route shall mean the specific haul route <br /> that has been designated by the City for any <br /> project or development and no other route shall <br /> be used. If a specific haul route has not been <br /> so designated, a direct route as used herein <br /> shall mean the most feasible route from the <br /> closest unrestricted street consistent with the <br /> intent to limit the use of streets in the City <br /> of Pleasanton by commercial vehicles. <br /> <br /> Section 2: This ordinance shall be published once within <br /> fifteen (15) days after its adoption in "The Valley <br /> Times," a newspaper of general circulation published <br /> in the City of Pleasanton. <br /> <br /> Section 3: The City Council finds that this amendment is merely <br /> declaratory of existin~ law. <br /> <br /> Section 4: This ordinance shall be effective thirty (30) days <br /> after the date of its final passage and adoption. <br /> INTRODUCED at a regular meeting of the City Council of the City <br /> of Pleasanton on March 13, 1984. <br /> <br /> <br />
