CITY COUNCIL OF THE CITY OF PLEASANTON AL~DA COUNTY, CALIFORNIA ORDINANCE NO. 1129 AN ORDINANCE A~NDING TITLE V, CHAPTER5, ARTICLE 1 OF THE ORDINANCE CODE OF THE CITY OF PLEASANTON TO REQUIRE TRUCKS TO USE DESIGNATED HAUL ROUTES THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS FOLLOWS: Section 1: Title V, Chapter 5, Article 1, Section 5-5.03(A) is amended in its entirety to read as follows: "§ 5-5.03 Exceptions. A. Pickups and Deliveries. This article shall not prohibit any commercial vehicles coming from an unrestricted street having ingress and egress by direct route to and from a restricted street when necessary for the purpose of making pickups or deliveries of goods, wares and merchandise from or to any building or structure located on the restricted street or for the DurDose of delivering materials to be used in the actual and bona fide repair, alteration, remodeling or construction Of any building or structure upon the restricted street for which a building permit has previously been obtained. As used herein direct route shall mean the specific haul route that has been designated by the City for any project or development and no other route shall be used. If a specific haul route has not been so designated, a direct route as used herein shall mean the most feasible route from the closest unrestricted street consistent with the intent to limit the use of streets in the City of Pleasanton by commercial vehicles. Section 2: This ordinance shall be published once within fifteen (15) days after its adoption in "The Valley Times," a newspaper of general circulation published in the City of Pleasanton. Section 3: The City Council finds that this amendment is merely declaratory of existin~ law. Section 4: This ordinance shall be effective thirty (30) days after the date of its final passage and adoption.
