CONSIDER AN APPLICATION FOR A <br /> PUD MAJOR MODIFICATION TO ADD 36 NEW UNITS IN FIVE BUILDINGS <br /> AND MISCELLANEOUS SITE MODIFICATIONS AT THE CIVIC SQUARE <br /> APARTMENTS LOCATED AT 4800 BERNAL AVENUE AND TO CONSIDER <br /> A LOW- AND MODERATE INCOME HOUSING AGREEMENT. <br /> SUMMARY <br /> This is the revised application by Civic Square, L.L.C. and Andy Byde (Braddock and <br /> Logan Services, Inc.) for a PUD major modification to add 36 new units in five buildings <br /> at the Civic Square Apartments located at 4800 Bernal Avenue, and for a moderate- and <br /> low- income housing agreement for the entire development. The revised proposal <br /> implements the Pleasanton General Plan; provides affordable multi family rental housing <br /> for low- and moderate income families in close proximity to the downtown, public transit, <br /> and schools; will provide four ADA accessible and 10 ADA adaptable units; will achieve a <br /> minimum 100 LEED green building points; and will provide new amenities for the Civic <br /> Square residents. <br /> HOUSING COMMISSION ACTION <br /> On February 18, 2010, the Housing Commission, on a 5 -0 vote, recommended approving <br /> the draft Moderate- and Low- Income Housing Agreement (Attachment 3). <br /> PLANNING COMMISSION ACTION <br /> On March 10, 2010, the Planning Commission, on a 5 -0 vote, recommended approving <br /> the proposed modification subject to the conditions of approval (Attachment 1). <br /> FINANCIAL STATEMENT <br /> The applicant will pay all required building permit and development fees including the <br /> residential school impact and regional traffic impact fees; will pay property taxes; will <br /> provide 36 rental units affordable to moderate- and low- income households in perpetuity; <br /> and will administer the housing agreement with the City. <br /> RECOMMENDATION <br /> Staff recommends the City Council make the PUD development plan findings in <br /> Attachment 4, introduce the ordinance approving Case PUD- 84 -21 -4M subject to the <br /> draft conditions of approval in Attachment 1, and adopt the draft resolution approving the <br /> moderate- and low- income housing agreement in Attachment 3. <br />
