RESOLUTION NO. 10 -351 <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> DECLARING ITS INTENTION TO MODIFY THE MANAGEMENT DISTRICT PLAN OF <br /> THE TRI- VALLEY TOURISM BUSINESS IMPROVEMENT DISTRICT <br /> WHEREAS, on January 3, 2006, the City Council of the City of Pleasanton adopted <br /> Ordinance Number 1929 adopting the Management District Plan and establishing the Tri- Valley <br /> Tourism Business Improvement District (TVTBID); and <br /> WHEREAS, the Property and Business Improvement District Law of 1994, Streets and <br /> Highways Code §36600 et seq., allows cities to modify the Management District Plan (MDP) at <br /> the request of the owners' association; and <br /> WHEREAS, the TVTBID owners' association, the Tri Valley Convention Visitors <br /> Bureau (TVCVB) has requested modification of the MDP. <br /> NOW THEREFORE BE IT RESOLVED the City Council of the City of Pleasanton does <br /> hereby resolve, determine and find as follows: <br /> SECTION 1. The recitals set forth herein are true and correct <br /> SECTION 2. The City Council declares its intention to modify the TVTBID MDP. <br /> SECTION 3. The proposed modification of the TVTBID MDP will shorten the duration of <br /> the TBID, from five years to four years and five months. The modification will cause the TVTBID <br /> to expire on July 15, 2010. <br /> SECTION 4. The time and place for a public hearing on modification of the TVTBID MDP <br /> are set for 7:00 p.m., or as soon thereafter as the matter may be heard, on June 15, 2010 at the <br /> Council Chamber located at 200 Old Bernal Avenue, Pleasanton, CA 94566. <br /> PASSED, APPROVED, AND ADOPTED by the City Council of the City of Pleasanton at <br /> a regular meeting held on April 20, 2010. <br /> I, Karen Diaz, City Clerk of the City of Pleasanton, California, certify that the foregoing <br /> resolution was adopted by the City Council at a regular meeting held on the 20th day of April, <br /> 2010, by the following vote: <br /> Ayes: Councilmembers Cook- Kallio, McGovern, Sullivan, Thorne, Mayor Hosterman <br /> Noes: None <br /> Absent: None <br /> Abstain: None <br /> AI 4_ r 4 <br /> Karen Diaz, City erk <br /> APPROVED AS TO FORM: <br /> Jon- Lowell, City Attorney <br />
