Mayor Hosterman proposed the following: "Shall the Oak Grove property in the City's southeast hills, creating 497 acres of open space and ensuring our urban growth boundary, be approved She offered to add language stating a maximum of 51 home sites. Councilmember McGovern said it is overtly political and actually provides verbiage which supports the developer. Vice -Mayor Thorne said he would prefer to use absolutely neutral language in the ballot question and defer to the ballot argument for more detailed information. He supported Councilmember Cook- Kallio's suggestion. Councilmember McGovern said she could support that if there were not Council support for her motion. SUBSTITUTE MOTION: It was m/s by Cook Kallio /Hosterman to identify the ballot question as, "Shall the development plan for the Oak Grove property be approved Motion passed by the following vote: Ayes: Councilmembers Cook Kallio, McGovern, Sullivan, Thorne, Mayor Hosterman Noes: None Absent: None MOTION: It was m/s by McGovern /Cook Kallio to direct the City Attorney to prepare an impartial analysis. Motion passed by the following vote: Ayes: Councilmembers Cook Kallio, McGovern, Sullivan, Thorne, Mayor Hosterman Noes: None Absent: None Mr. Fialho advised the Council to set deadlines for the submission of ballot arguments. Ms. Seto said that following further discussion with the City Clerk, if the Council would prefer more time to craft rebuttal arguments then the direct argument due date could be pushed back to March 15 with rebuttals due March 25` MOTION: It was M/S Sullivan /McGovern to establish the due dates for direct ballot arguments as March 15, 2010 and for rebuttal arguments as March 25, 2010. Motion passed by the following vote: Ayes: Councilmembers Cook Kallio, McGovern, Sullivan, Thorne, Mayor Hosterman Noes: None Absent: None Ms. Seto explained that the Elections Code establishes a priority of whose arguments get published, with the Council receiving the highest priority. If the Council should choose not to form a subcommittee to draft the argument then the proponents of the referendum would have the next highest priority. Council discussed the various options for writing and signing ballot augments and rebuttals. MOTION: It was m/s by Cook- Kallio/Thorne to authorize Councilmember Cook Kallio and Vice Mayor Thorne to author the direct ballot argument in favor of the project and to authorize the referendum proponents and Councilmembers McGovern and Sullivan to author the direct ballot argument against the project.
