Councilmember Sullivan inquired about the cost of the November election if it did not include
this item. Mr. Fialho referred to the staff report, which specifically states a cost of $79,000.
Councilmember Sullivan asked and Mr. Fialho confirmed that would be the cost whether this
item is included or not. Ms. Diaz noted that the only additional cost would be printing the
Ordinance text.
Councilmember McGovern said she supports the community in its position against ridgeline
development and its request that the developer return with a project that includes a park and
meets the significant requirements of Measures PP and QQ.
MOTION: It was m/s by McGovern /Sullivan to repeal Ordinance No. 1961.
Councilmember Sullivan said this project, which he initially supported, has transcended the
issue of hillside development and is now about the public process, disclosure of information,
and democracy. He said the fact that two Councilmembers are not allowed the time to obtain
the information they need indicates a serious problem with the public process and democracy in
this City. He said he has been involved in every referendum initiative effort in Pleasanton over
the last 15 years and witnessed the harassing tactics using by the developer of the Ponderosa
project. He said it was fortunate that Council understood the issue and rescinded the project,
sending the message to the developer that public process and the people's constitutional right
to overturn their City Council is more important than a housing project.
Mayor Hosterman cited the 1990 referendum concerning a similar project.
Vice -Mayor Thorne said he could not support the request to repeal. He said he was not
convinced that that those who signed the petition and who voted in favor of Measures PP and
QQ would vote to uphold the referendum.
Councilmember Cook Kallio said her goal has always been to try and balance the needs of the
community. She acknowledged that some would like the Council to see things in black and
white, which is impossible.
Councilmember McGovern recommended that voters review the public record for this project.
MOTION failed by the following vote:
Ayes: Councilmembers McGovern, Sullivan
Noes: Councilmembers Cook Kallio, Thorne, Mayor Hosterman
Absent: None
MOTION: It was m/s by Cook- KallioiThorne to submit Ordinance No. 1961 to the voters.
