C. General Plan Reorganization. The General Plan may be reorganized, and individual provisions may be renumbered or reordered in the course of ongoing updates of the General Plan in accordance with the requirements of state law, but Land Use Policy 15 and Programs 15.1 through 15.2 shall continue to be included in the Genial Plan unless repealed or amended pursuant to the procedures set forth above or by the voters of the City. D. Takings. The City Council may amend the policy and/or programs adopted by this initiative if it makes each of the following findings: (1) That an application for an amendment to the policy and/or programs adopted by this initiative has been rejected by the voters of the City of Pleasanton; (2) That following the rejection of the proposed amendment to the policy and/or programs adopted by this initiative, the final judgment of a court of competes jurisdiction concludes that the application of any aspect of that policy and/or programs would constitute an unconstitutional taking of a landowners property; and (3) That the amendment will allow additional residential development only to the minimum extent necessary to avoid the unconstitutional taking of the landowner's property. Section 5. }remotion for Certain Proiecb This initiative shall not apply to any development project that has obtained as of the effective date of the initiative a vested right pursuant to state kw. Section 6. Severability If any portion of this initiative is hereafter declared invalid by a court of competent jurisdiction, all remaining portions are to be considered valid and shall remain in fiill force and effect.
