Advantages: <br /> The only alternative that assures the end of this litigation with petitioner and <br /> intervener. <br /> Recognizes the interests of both parties and sets parameters for moving forward. <br /> Perhaps the fastest alternative to return permitting authority to the City. <br /> Disadvantages: <br /> Require areas of compliance that may be overturned in future litigation <br /> Will result in the elimination of the housing cap and changes to the Hacienda <br /> development review and approval process. <br /> May require an accelerated schedule for matters related to amending the General <br /> Plan to eliminate the housing cap and preparation of the Housing Element. <br /> Summary <br /> The City Council is considering at a second public meeting this matter to both educate <br /> the public and to get its input regarding available options. Following this meeting, the City <br /> Council intends to provide direction to staff and legal counsel regarding a preferred <br /> course of action. Due to the timetable established by the Court, it is anticipated that this <br /> direction will occur within 7 to 14 days of this meeting.
