1 <br /> MINUTES <br /> CITY OF PLEASANTON <br /> REGULAR CITY COUNCIL MEETING <br /> February 16, 2010 <br /> CALL TO ORDER <br /> Mayor Hosterman called the regular meeting to order at the hour of 7:00 p.m. Councilmember <br /> Cook Kallio led the Pledge of Allegiance and provided the introductory remarks. <br /> ROLL CALL <br /> Present: Councilmembers Cook Kallio, McGovern, Sullivan, Thorne, Mayor Hosterman <br /> Absent: None <br /> CLOSED SESSION REPORT <br /> City Attorney Jonathan Lowell reported that the Council met in Closed Session on 2 items. On <br /> the first item, regarding existing litigation, the Council took no reportable action but will consider <br /> the matter further under regular Agenda Item 11. The Council also met to discuss written <br /> communication received from the Lin's legal counsel regarding removal of the poison pill <br /> provision from Ordinance No. 1962. Should Ordinance No. 1961 be set aside by referendum, <br /> the provision would invalidate Ordinance No. 1962 which adopted the Oak Grove Development <br /> Agreement. <br /> It was m/s by McGovern /Sullivan and passed 4 -1 with Councilmember Cook Kallio voting to <br /> leave the provision in both ordinances. <br /> Councilmember Cook Kallio stated that she understood litigation concerns but her vote is <br /> consistent with her original position when the matter came before the Council in October 2007. <br /> MEETING OPEN TO THE PUBLIC <br /> 10. Pleasanton Library Newcott Caldebery Young Authors' Acknowledgment <br /> Councilmember Cook Kallio introduced Pleasanton Library Children's Librarian Sandy Silva. <br /> Ms. Silva provided background on the Newcott Caldebery Young Authors and Illustrators and <br /> introduced this year's participants. <br /> AGENDA AMENDMENTS <br /> Councilmember Sullivan requested continuance of Item 11, stating that Closed Session did not <br /> provide him with the information necessary to form a sound decision. He requested that <br /> information of staff during Closed Session and said he, as well as the rest of the Council, should <br /> have an opportunity to review it before moving forward. He said that information would largely <br /> influence whatever decision is made and, with respect to the constraints imposed by Closed <br /> Session, requested the same information be presented to the public to the extent possible. <br /> Councilmember McGovern supported the request, noting she asked for the same information. <br />
