Section 9: Article 25 (Conditional Uses) of Chapter 2 (Zoning) <br /> of Title II (Zoning and Development) of the Ordinance <br /> Code of the City of Pleasanton is hereby amended by <br /> adding a new section to read as follows: <br /> <br /> "§2-11.20 Use Permits for Large Famil.y Day Care Homes. <br /> <br /> a. Procedure. Applications for large family <br /> day care homes shall be processed in <br /> accordance with the provisions of this <br /> section. <br /> <br /> 1. Application and Fee. Application for <br /> a large family day care home use permit <br /> shall be filed with the Zonin~ Adminis- <br /> trator in accordance with the requirements <br /> of §2-11.04 of this Article. <br /> <br /> 2. Notice. No less than 10 days Drior to <br /> the date on which the decision will be <br /> made on the application, the Zoning <br /> Administrator, or his designee, shall <br /> give notice of the proDosed use by mail <br /> to all owners shown on the last equalized <br /> assessment roll as owning real property <br /> within 100 feet of the exterior boundaries <br /> of the site of the proposed use. <br /> <br /> 3. Public Hearing. If a hearing is requested <br /> by the applicant, or other affected <br /> person, a Dublic hearing before the Zoning <br /> Administrator shall be held Drior to a <br /> decision being made. No Dublic hearing <br /> shall be held unless such a hearing is <br /> requested. <br /> <br /> b. Action of the Zoning Administrator. Upon close <br /> of the public hearing, if a hearing has been <br /> requested, or at the time set for the decision <br /> in the notice, the Zoning Administrator shall <br /> approve, approve in modified form, or deny <br /> the application. The Zoning Administrator <br /> shall grant the use permit if the proDosed <br /> large family day care home, as applied for or <br /> as conditioned, complies with the standards <br /> set forth in this section. Any action of the <br /> Zoning Administrator may be appealed to the <br /> Plannin~ Commission. <br /> <br /> c. Standards. Large family day care homes shall <br /> be required to meet the following requirements: <br /> <br /> 1. Spacing. No large family day care home <br /> shall be approved if the site of the <br /> proposed use is located within 300 feet <br /> of the exterior boundary of another larKe <br /> <br /> -3- <br /> <br /> <br />
