CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA ORDINANCE NO. 1120 AN ORDINANCE APPROVING THE APPLICATION OF KEN GOOCH AND ASSOCIATES FOR A MODIFICATION TO THE CONDITIONS OF APPROVAL OF PUD-80-13 (TRACT 5004), AN APPROXIMATELY 10 ACRE RESIDENTIAL PROJECT CONSISTING OF 28 SINGLE-FAMILY LOTS AND AN APPROX- IMATELY 2.47 ACRE AREA SET ASIDE FOR FUTURE TOllHOUSE DEVELOPMENT, LOCATED ON THE EAST SIDE OF RO~rELL LANE, TO ELIMINATE A REQUIRED ACCESSWAY FROM THE PROJECT TO AN ADJACENT CITY PARK WHEREAS, Council previously approved an amendment to the final subdivision map for the approximately 10 acre Dorothy Johnson property east of Rowell Lane between Vineyard Avenue and Kottinger Park which removed a pedestrian accessway between Rowell Lane and Kottinger Park from the map; and WHEREAS, because this accessway has turned into a controversial issue, the staff determined that the PUD modification would need to be considered by Council with a recommendation from the Planning Commission; and WHEREAS, a duly noticed public hearing was held on January 9, 1984 at which time testimony was heard from the public; and WHEREAS, Council considered testimony and the report of the Director of Planning and Community Development which outlined this situation in detail; THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS FOLLOWS: Section 1: Case PUD-80-13 is hereby modified to eliminate the requirement for an accessway between the end of Rowell Lane and Kottinger Park. Section 2: This ordinance shall be published once within fifteen (15) days after its adoDtion in "The Valley Times," a newspaper of general circulation published in the City of Pleasanton. Section 3: This ordinance shall be effective thirty (30) days after the date of its final passage and adoption.
