THE CITY OF 9 <br /> CITY COUNCIL AGENDA REPORT <br /> pL•E ASANTONe <br /> April 6, 2010 <br /> Community Development <br /> Engineering Division <br /> TITLE: APPROVE FIRST AMENDMENT TO AGREEMENT WITH LAGUNA OAKS <br /> PLEASANTON OWNERS ASSOCIATION (HOA) FOR THE MAINTENANCE <br /> OF LANDSCAPING <br /> SUMMARY <br /> In 1999 the City agreed to suspend the Lighting and Landscape Maintenance District <br /> that had been created for the Laguna Oaks subdivision in exchange for the Laguna <br /> Oaks Homeowners Association agreement to maintain the landscaping of the area. <br /> Inadvertently, the agreement between the City and the HOA did not identify all the <br /> improvements, such as the masonry walls and wrought iron fences that were identified <br /> in the Maintenance District. In order to resolve these discrepancies, the attached <br /> amendment to the Maintenance Agreement has been negotiated and signed by the <br /> HOA. <br /> RECOMMENDATION <br /> Authorize the City Manager to sign the attached Amendment. <br /> FINANCIAL STATEMENT <br /> There is no financial impact to the City. <br />
