CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALA}~EDA COUNTY, CALIFOPjqlA <br /> <br /> ORDINANCE NO. 1115 <br /> <br /> ORDINANCE AMENDING LAPSING PROVISIONS OF THE <br /> GROWTH MANAGEMENT PROGRAM TO RECOGNIZE SUB- <br /> DIVISIONS AS VESTING GROI,~FH ~NAGEME.~]T PROGP~IM <br /> APPROVAL <br /> <br /> THE CITY COUNCIL OF THE CITY OF PLEASA.~]TON DOES HEREBY ODDAIN <br /> AS FOLLOWS: <br /> <br /> Section 1: Section 2-30.05 (b)(9) is amended to read as follows: <br /> <br /> " (9) Lapse of DeveloDment Approval. Any <br /> development approval for projects granted under <br /> the yearly allocation for smaller projects shall <br /> lapse and be of no further force and effect as of <br /> eighteen (18) months from the date small project <br /> approval is received unless either: <br /> <br /> (i) construction has commenced on any building <br /> in the project, or <br /> <br /> (ii) City Council has approved a final map and <br /> subdivider has entered into a subdivision <br /> agreement (including bondinR for public <br /> improvements as appropriate) for the project. <br /> <br /> In addition, failure to pay Growth Management fees <br /> at the times specified in Exhibit "A" to Resolution <br /> No. 82-66 as amended by Resolution No. 82-440 or <br /> as later amended may result in lapse of small <br /> project approval. Council may at its discretion <br /> extend the period in which to corranence construction <br /> for any project." <br /> <br />Section 2: This ordinance shall be published once within <br /> fifteen (15) days after its adoption in "The Valley <br /> Times ," a newspaper of general circulation published <br /> in the City of Pleasant on. <br /> <br />Section 3: This ordinance shall be effective thirty (30) days <br /> after the date of its final passage and adoption. <br /> <br />INTRODUCED at a regular meeting of the City Council of the City <br />of Pleasanton on December 6, 1983. <br /> <br />ADOPTED at a regular meeting of the City Council of the City of <br />Pleasanton on January 9, 1984 by the following vote: <br /> <br /> <br />
