CITY COUNCIL OF THE CITY OF PLEASANTON ALAJ{EDA COUNTY, CALIFORNIA ORDINANCE NO. 1113 ORDINANCE APPROVING DEVELOPMENT AGREE~ENTS BETI,~EN THE CITY OF PLEASANTON AND THE PRUDENTIAL INSURANCE COMPANY OF AMERICA AND BETI, rEEN THE CITY OF PLEASANTON AND CALLAHAN-PENTZ PROPERTIES, PLEASANTON WHEREAS, Government Code Section 65864 through Section 65869.5 authorizes cities and counties to enter into binding development agreements with persons having leKal or equitable interests in real Droperty for the develop- ment of such property; and WHEREAS, The Prudential Insurance Company of America and Callahan-Pentz Properties, Pleasanton, co-developers of the 573-acre Hacienda Business Park, made aDplication to the City to enter into such agreements provided for in the Governement Code; and ~MEREAS, after public notice, the Planning Commission held a hearing on November 21, 1983 and recommended approval of the development agreements as proposed; THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS FOLLOWS: Section 1: Finds that the proposed Development Agreements for Hacienda Business Park are consistent with the Citv's General Plan. Section 2: Approves the DeveloPment Agreement between the City of Pleasanton and The Prudential Insurance ComDany of America, a copy of which can be reviewed at the City Attorney's office, 200 Bernal Avenue, Pleasanton, California. Section 3: Approves the Development Agreement between the City of Pleasanton and Callahan-Pentz Properties, Pleasanton, a copy of which can be reviewed at the City Attorney's office, 200 Pernal Avenue, Pleasanton, California. Section 4: Authorizes the appropriate city officials to execute said agreements. Section 5: This ordinance shall be published once within fifteen (15) days after its adoption in "The Valley Times", a newspaper of general circulation published in the City of Pleasanton.
