BACKGROUND <br /> On December 4, 2007, City Council approved a consulting contract with Mosaic <br /> Associate for the subject project. The original amount of the contract was not to exceed <br /> $183,323. Mosaic has prepared detailed wetland /riparian plans and mitigation plans. In <br /> addition, they assisted the City in obtaining permits required by other agencies. Mosaic <br /> also conducted preconstruction wildlife and land surveys, construction monitoring, and <br /> one year of post- construction mitigation monitoring and reporting for this project. <br /> The construction of Bernal Bridge and the associated wetland mitigation has been <br /> completed but acceptance has been on hold during the one year maintenance period <br /> (ending April 15, 2010) as required by the construction contract. Acceptance of the <br /> constructed improvements is expected to occur shortly after the end of the maintenance <br /> period. <br /> DISCUSSION <br /> The proposed Amendment No. 1 (see Attachment 1) includes Exhibit A -1 that details <br /> the additional scope of services and contract amount. This amendment includes $3,687 <br /> for work performed during the first year that exceeded the scope and budget of the <br /> original contract. Staff believes these additional services were warranted and <br /> reasonable. This amendment also includes mitigation monitoring and reporting for <br /> years two through five ($111,507), as required by the Nationwide 401 permit from the <br /> U. S. Army Corps of Engineers. <br /> The scope of the services to be provided by Mosaic Associates includes biological <br /> mitigation monitoring and reporting, hydrologic monitoring and reporting, and agency <br /> coordination for mitigation site approval. The mitigation monitoring involves three site <br /> visits per year to each site to collect data and assess site performance. Hydrologic <br /> monitoring will consist of site visits every six weeks to retrieve data, and measure and <br /> evaluate water level, temperature, inflow and specific conductance. Mosaic Associates <br /> will conduct a separate wetland delineation for the Mission Creek site. The scope also <br /> includes project coordination and administration tasks. Staff has reviewed Mosaic <br /> Associates' proposal for this work and has determined that all included services are <br /> necessary and the costs are reasonable. Staff recommends that City Council approve <br /> Amendment No. 1 in the amount of $115,194, bringing the total not -to- exceed contract <br /> amount to $298,517. <br /> Submitted by: Fiscal Review: Approved by: <br /> 4_1 4/it__ <br /> Brian Dolan C <br /> Director David P.
