Upon any other City breach of this Agreement or its obligations hereunder, Owner, after providing City with written notice of the alleged breach as is reasonably practical in the circumstances, shall have the right to take such legal action against the City and others that may be available at law or in equity as Owner determines to be appropriate. 6. Notices. Comments or other notices required or permitted to be given hereunder shall be given in writing and shall be delivered (a) in person, (b) by a nationally recognized overnight delivery service, (c) by certified or registered U.S. Mail with postage prepaid, return receipt requested, or (d) facsimile. Notices shall be effective on the date of delivery or receipt, or if delivery is not accepted, on the earlier of the date that delivery is refused or five (5) days after the date the notice is mailed. California Law.
