BACKGROUND <br /> The "Village at Ironwood" is the second phase of the residential subdivision proposed by <br /> Ponderosa Homes. The property is located on the north side of the Operations Services <br /> Center as shown on the attached vicinity map (Attachment 1). <br /> After approving the Vesting Tentative Map in April 2009, the City Council approved <br /> Tract 8004 with three residential and five large parcels (for future subdivision) on <br /> September 15, 2009. Tract 8023 is a subdivision of lots 4, 6 and 7 of Tract 8004. The <br /> remaining parcels (5 and 8) of Tract 8004 will be subdivided with the future phase. <br /> Tract 8004, Phase I, includes construction of the cul -de -sac serving lots 1 -6 of Tract <br /> 8023 (Bradford Court), the extension of the entrance street, Bradford Way (formerly <br /> Reimers Drive), into and through the development, construction of Bingham Court and <br /> and Dorset Court, as well of as partial construction of Bingham Street, Felton Street, <br /> and Newport Street. All the streets, underground utilities, and structures will be built with <br /> Tract 8004, Phase I (see Attachment 2 for layout of Tract 8023). There are no <br /> improvements to be constructed with Tract 8023. <br /> The Engineering staff, Planning staff, and the City Attorney's Office have reviewed the <br /> Final Map and other legal documents for Tract 8023. All submittals are in substantial <br /> conformance with the PUD and Tentative Map approvals. Development fees have been <br /> paid and a signed Subdivision Agreement has been submitted. <br /> Proposed Improvements <br /> This phase of the development proposes no new streets. All streets necessary to <br /> provide access to all 40 lots of Tract 8023 have been bonded and permitted for <br /> construction with Tract 8004, Phase I. <br /> Trail Connection <br /> An eight -foot wide unpaved trail will be constructed adjacent to the northern boundary of <br /> this development with a future phase of development. This trail will start near the Mohr <br /> Avenue/lrongate Court intersection and head east within the former Mohr Avenue right <br /> of -way to provide access to future uses in the East Pleasanton Specific Plan. <br /> Additionally, there will be a connection to the trail via the development (with a locked <br /> gate) to allow project residents direct access to the trail. <br /> DISCUSSION <br /> Discretion to Deny the Final Map <br /> The approval of a final map when the final map substantially complies with the <br /> conditions of the tentative map is a mandatory, ministerial act. (Government Code, <br /> Section 66474.1). Put another way, a final map shall be disapproved only for failure to <br /> meet conditions that were applicable at the time the tentative map was approved. If the <br /> final map is disapproved, there must be a finding identifying the conditions which were <br /> not met (Government Code, section 66473). <br /> Page 2 of 3 <br />
