use of the groundwater well by the Owners for irrigation of landscaping on the Premises <br /> (as the Owners have connected to the City's municipal water system for domestic <br /> household water use), the parties agreed that the Owners could connect to the golf course <br /> irrigation lines to irrigate the landscaping on the Premises for a set duration. The parties <br /> now desire to execute this Agreement to memorialize this temporary no cost use of golf <br /> course irrigation water to irrigate landscaping on the Premises. <br /> NOW, THEREFORE, IN CONSIDERATION OF THE MUTUAL COVENANTS AND <br /> CONDITIONS IDENTIFIED HEREIN, THE PARTIES HEREBY AGREE AS FOLLOWS: <br /> 1. PERMISSION TO ENTER LICENSE AREA. City grants permission to Owners (including <br /> their contractors and agents) to enter the License Area for the purpose of constructing a fence, <br /> and installing and maintaining landscaping and irrigation systems. Such fence, landscaping <br /> and irrigation shall not unreasonable interfere with City's operation of the golf course, or use <br /> of the golf cart path by golfers. Owners acknowledge and agree that no accessory structures <br /> may be constructed in the License Area. <br /> 2. PERMISSION TO USE GOLF COURSE IRRIGATION WATER. City grants permission to <br /> Owners to continue to use the connections (previously created during the construction of the <br /> golf course) between the Premises landscape irrigation lines and the golf course irrigation <br /> lines at the two connection points shown in Exhibit B, attached hereto and incorporated <br /> herein by this reference. <br /> A. Owners may continue to draw non potable water from the golf course irrigation lines <br /> to water the landscaping on the Premises at no cost to Owners, until the expiration of <br /> the term described in Section 3. b., below. <br /> B. Owners acknowledge that no water from the golf course irrigation lines, which <br /> includes non potable water from golf course run -off, may be used for any purposes <br /> other than watering the landscaping on the Premises, including, but not limited to, <br /> domestic or any other purposes within the home on the Premises, or for any pool or <br /> spa (if built) on the Premises. <br /> C. Owners agree to diligently monitor the two connection points and irrigation lines on <br /> the Premises to limit and immediately repair any irrigation line breaks or water <br /> leakage. <br /> D. Owners acknowledge that the City may install, at the City's cost, water meters at the <br /> two connection points to track water usage by the Owners. If the water meters detect <br /> a low flow leak, or if City monitoring of water usage indicates excessive usage <br /> compared to similar sized lots with similar features, the parties shall meet to discuss <br /> required repairs or changes to irrigation patterns to be done by Owners, at Owners' <br /> expense. Excessive use of water compared to similar sized lots with similar features <br /> by Owners may result in the City closing these two connections, or charging Owners <br /> Page 2 of 5 <br />
