§ 5-9.16 Liability Insurance. <br /> <br /> a. Insurance Required. Each person prior to the <br /> granting of an encroachment permit under this <br /> Article shall furnish to the City a certificate <br /> showing that such person has then in force public <br /> liability and property damage insurance, naming <br /> the City as an additional inst~red~ in an amount <br /> not less than One Hundred Tbousand and no/100ths <br /> Dollars ($100 ~ 000,00) nrinimum ] i ability combined <br /> single limit (bodily injury and property damage) <br /> per person and per occurrence. The permit holder <br /> shall provide and keep in force that policy of <br /> public liability insurance during such time as it <br /> continues to locate any newsrack under the terms <br /> of this Article. The evidence of insurance filed <br /> with the City shall include a statement by the <br /> insurance carrier that thirty (30) days notice <br /> will be given to the City before any cancellation. <br /> <br /> b. Exception to Insurance Re uirement. Upon a showing <br /> made before the City Co~c~' that there.is substantial <br /> hardship to a newspaper in meeting the ~nsurance <br /> required in §5-9.16(a) above, the City Council <br /> shall reduce or waive the insurance'requirements. <br /> Substantial hardship as used herein shall mean the <br /> financial inability of the newspaper to meet the <br /> insurance requirements. <br /> <br /> § 5-9.17 Indemnification- Every person operating or <br /> maintaining a newsYupon or within the public property, <br /> rights-of-way, or public easements adjacent to streets <br /> of this City shall agree, prior to the granting of an <br /> encroachment permit, to indemnify and hold harmless <br /> the City of pleasanton, its officers and employees, <br /> from any loss, liability, damage, or cost sustained by <br /> any person or property, arising from the installation, <br /> operation, or use of such newsrack; provided, however, <br /> that such obligation to indemnify and hold harmless the <br /> City of pleasanton, its officers and employees, shall <br /> not extend to any loss, liability damage, or cost <br /> resulting from the acts or property of another. <br /> <br /> II1 <br /> <br /> <br />
