§ 5-9.16 Liability Insurance. a. Insurance Required. Each person prior to the granting of an encroachment permit under this Article shall furnish to the City a certificate showing that such person has then in force public liability and property damage insurance, naming the City as an additional inst~red~ in an amount not less than One Hundred Tbousand and no/100ths Dollars ($100 ~ 000,00) nrinimum ] i ability combined single limit (bodily injury and property damage) per person and per occurrence. The permit holder shall provide and keep in force that policy of public liability insurance during such time as it continues to locate any newsrack under the terms of this Article. The evidence of insurance filed with the City shall include a statement by the insurance carrier that thirty (30) days notice will be given to the City before any cancellation. b. Exception to Insurance Re uirement. Upon a showing made before the City Co~c~' that there.is substantial hardship to a newspaper in meeting the ~nsurance required in §5-9.16(a) above, the City Council shall reduce or waive the insurance'requirements. Substantial hardship as used herein shall mean the financial inability of the newspaper to meet the insurance requirements. § 5-9.17 Indemnification- Every person operating or maintaining a newsYupon or within the public property, rights-of-way, or public easements adjacent to streets of this City shall agree, prior to the granting of an encroachment permit, to indemnify and hold harmless the City of pleasanton, its officers and employees, from any loss, liability, damage, or cost sustained by any person or property, arising from the installation, operation, or use of such newsrack; provided, however, that such obligation to indemnify and hold harmless the City of pleasanton, its officers and employees, shall not extend to any loss, liability damage, or cost resulting from the acts or property of another.
