CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA ORDINA?]CE NO. 1103 AN ORDINANCE ADDING A NEW ARTICLE 5 (NEWSRACKS AND SIMILAR DISPENSERS) TO CHAPTER 8, TITLE V OF THE ORDINANCE CODE OF THE CITY OF PLEASANTON THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS FOLLOWS: Section 1: Adoption of Article 5. A new Article 5 (Newsracks and Similar Dispensers) as set forth more particularly in Exhibit "A" attached hereto and incorporated herein by this reference, is hereby added to Chapter 8 (Encroachments), Title V of the Ordinance Code of the City of Pleasantono Section 2: Severability. If any section, subsection, sentence, clause, or phrase of this ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of the ordinance. The City Council of the City of Pleasanton hereby declares that it would have passed this ordinance and each section, subsection, sentence, clause and phrase thereof, irrespective of the fact that any one or more other sections, subsections, sentences, clauses or phrases be declared invalid or unconstitutional. Section 3: Publication. This ordinance shall be published once within fifteen (15) days after its adoption in "The Valley Times," a newspaper of general circulation published in the City of Pleasanton. Section 4: Effective Date. This ordinance shall be effective thirty (.30) days after the date of its final passage and adoption. However, recognizing the potential economic and operational effects of conforming existing newsracks to the requirements of this ordinance and in order to allow sufficient time for newspaDer companies and/or distributors to comDly with these requirements, no newsrack in use as ~f the effective date of this ordinance shall be required to conform to this ordinance until six (6) months after the effective date of this ordinance.
