THE CITY OF 7 <br /> CITY COUNCIL AGENDA REPORT <br /> pL E ASANTONo <br /> February 2, 2010 January 10, 2010 <br /> Community Development <br /> Planning Division <br /> TITLE: PAP -139 (PCUP -257), CONSIDER AN APPEAL OF THE PLANNING <br /> COMMISSION'S APPROVAL TO MODIFY THE EXISTING <br /> CONDITIONAL USE PERMIT (PCUP -129) FOR THE OPERATION OF <br /> REDCOATS BRITISH PUB AND RESTAURANT TO EXPAND THE <br /> DAYS /HOURS FOR INDOOR MUSIC <br /> SUMMARY <br /> Under consideration is whether a modification to the existing conditional use permit for <br /> Redcoats British Pub and Restaurant should be granted to allow DJ music and dancing <br /> inside from 9:00 p.m. to 12:00 midnight on Wednesdays and Thursdays. The Planning <br /> Commission approved the modification to the conditional use permit (5 -0 vote), subject <br /> to nine conditions of approval. The applicant does not oppose the Planning <br /> Commission's conditions of approval. <br /> Councilmember Thorne appealed the Planning Commission's approval to the City <br /> Council. <br /> PLANNING COMMISSION ACTION <br /> Approved the modification to the conditional use permit subject to the conditions of <br /> approval shown in Exhibit A of Attachment 1. <br /> RECOMMENDATION <br /> Staff recommends that the City Council adopt the attached draft resolution denying the <br /> appeal, thus upholding the Planning Commission's approval of Case No. PCUP -257, <br /> subject to the conditions of approval as shown in Exhibit A of Attachment 1. <br /> FINANCIAL STATEMENT <br /> No fiscal impact to the City or public services is anticipated. <br />
