ATTACHMENT 1 <br /> RESOLUTION NO. 10- <br /> RESOLUTION DENYING THE APPLICATION OF DON BABBITT /HEARTWOOD <br /> COMMUNITIES, FOR AMENDMENTS TO THE GENERAL PLAN AND THE HAPPY <br /> VALLEY SPECIFIC PLAN AND FOR PUD REZONING AND DEVELOPMENT PLAN <br /> APPROVAL, AS FILED UNDER CASE PUD -75 /PGPA -14 /PSPA -3 <br /> WHEREAS, Don Babbitt/Heartwood Communities has applied for amendments <br /> to the General Plan and the Happy Valley Specific Plan and for Planned Unit <br /> Development (PUD) rezoning and development plan approval for additional lots over <br /> the allotted number for the 6.13 -acre parcel located at 1157 Happy Valley Road; and <br /> WHEREAS, zoning for the property is PUD -SRDRI (Planned Unit Development <br /> Semi-Rural Density Residential) District; and <br /> WHEREAS, at its meeting of October 28, 2009, the Planning Commission, <br /> having considered all public testimony, relevant exhibits, and recommendations of City <br /> staff concerning this application, recommended denial of the application; and <br /> WHEREAS, at its meeting of February 2, 2010, the City Council received a report <br /> from the Director of Community Development, together with a copy of the staff report to <br /> the Planning Commission, regarding the application; and <br /> WHEREAS, the City Council held a public hearing on February 2, 2010, at which <br /> time the applicant and any other member of the public were offered an opportunity to <br /> present evident regarding the application; and <br /> WHEREAS, after a review of the materials presented, the City Council <br /> determined that the application is consistent with the General Plan, the Happy Valley <br /> Specific Plan, and the purposes of the PUD ordinance of the City of Pleasanton. <br /> NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF <br /> PLEASANTON DOES RESOLVE, DECLARE, DETERMINE, AND ORDER THE <br /> FOLLOWING: <br /> Section 1. Denies Case PUD -75 /PGPA -14 /PSPA -3, the application of Don <br /> Babbitt/Heartwood Communities for amendments to the General Plan and the Happy <br /> Valley Specific Plan and for Planned Unit Development (PUD) rezoning and <br /> development plan approval for additional lots over the allotted number for the 6.13 -acre <br /> parcel located at 1157 Happy Valley Road; and <br /> Section 2. Staff is directed to send a copy of this resolution to the applicant, <br /> along with a letter informing the applicant that he has ninety days from the date that the <br /> City Council adopted the resolution to file a legal action." <br /> 1 <br />
