Mr. Dolan stated that staff supported the elimination of Item F. <br />Ms. Harryman stated that Item F is a catch-all and is not needed if Items A-E and G <br />were met. <br />Commissioner Blank suggested that Item G be modified by adding the word “vibration” <br />after “visually, audibly….” <br />Ms. Harryman stated that it could be done. <br />Commissioner Blank stated that he could not support the recommendation if it were not <br />optional. He added that it makes no sense to require an author who writes a book to <br />have a business license. <br />Commissioner O’Connor noted that there are many people with home businesses who <br />do not have a business license. <br />Commissioner Narum moved to find that the adoption of the proposed <br />amendments to the Pleasanton Municipal Code are statutorily exempt from the <br />California Environmental Quality Act (CEQA) and to recommend approval of <br />PRZ-46 as shown in Exhibit A of the staff report, with modifications to <br />Section 18.104.030 as follows: <br />Delete Item F; and <br />Add the words “ or vibrations” after “by smell” under Item G. <br />Chair Pearce seconded the motion. <br />ROLL CALL VOTE: <br />AYES: Commissioners Narum, Pearce, and Pentin. <br />NOES: Commissioners Blank and O’Connor <br />ABSTAIN: None. <br />RECUSED: None. <br />ABSENT: Commissioner Olson. <br />Resolution No. PC-2009-44 recommending approval of PRZ-46 was entered and <br />adopted as motioned. <br />Commissioner Blank stated that the reason for his opposition is that he does not believe <br />the ordinance takes into account the reality of the way the Internet and Internet access <br />changes how people make a living in their spare time. He added that he believes <br />requiring a business license of those people who occasionally sell on eBay or of retired <br />individuals who wish to work on their memoirs and then sell them is a gross abuse of <br />that process. <br />Commissioner O’Connor concurred. <br />PLANNING COMMISSION MINUTES, November 18, 2009 Page 21 of 25 <br /> <br />
