Ms. Harryman replied that there would be no issues, and if the applicant meets all <br />requirements listed in a. through g., the zoning certificate would be issued over the <br />counter. <br />Commissioner O’Connor inquired what would happen if a zoning certificate that should <br />not have been approved is issued over the counter. <br />Mr. Dolan replied that planners make decisions like this everyday and that while <br />occasionally there are mistakes, they consult with Donna Decker or him, or sometimes <br />with several people, when questions arise.He noted that the planners are capable and <br />their judgment can be relied upon. <br />Commissioner O’Connor inquired if, in a worst-case scenario, there is a mechanism to <br />fix any administrative errors made. <br />Ms. Harryman replied by giving the following example: Item E states, “No signs <br />advertising the business shall be allowed on the property.” If a business with a sign is <br />issued a zoning certificate because the planner did not catch that the box was not <br />checked, the application would become a Code Enforcement matter. The Code <br />Enforcement Officer would then inform the applicant [“he”] that he cannot have the sign <br />and that if he wishes to keep the sign, his zoning certificate would no longer be <br />sufficient, and he would need to apply for a home occupation or business permit. <br />Commissioner Narum inquired if it would be a case of double jeopardy if the applicant <br />checks the box that he has a sign, which is overlooked by staff, and a zoning certificate <br />is issued. <br />Ms. Harryman explained that a zoning certificate issued in error does not change the <br />fact that the applicant should not have been issued a zoning certificated and that the <br />application is in another category. <br />Commissioner Blank inquired if the ordinance is stating that there is no home <br />occupation that does not require a zoning certification. <br />Ms. Harryman said yes. <br />Commissioner Blank inquired if someone selling something on e-Bay would require a <br />zoning certificate by this regulation. <br />Ms. Harryman replied that she believed this would be correct. <br />Commissioner Blank stated that he could not support such a regulation.
