CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA ORDINANCE NO. 1292 AN ORDINANCE DEFERRING IMPOSITION OF THE CITY'S RESIDENTIAL CONSTRUCTION TAX UNTIL FINAL INSPECTION PREAMBLE A. The State Legislature has adopted Government Code Section 53077.5 (AB 3314, which is Chapter 685 of 1986 Statutes). AB 3314 takes effect on January 1, 1987 and requires that certain fees and charges cannot be collected until the final building inspection. B. The City hereby determines that its residential construction tax may fall within the purview of the AB 3314 requirements- NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS FOLLOWS: Section 1: Section 3.24.040 of the Pleasanton Municipal Code is hereby amended in its entirety to read as follows: "3.24.040 Time of payment-Refunds A. The residential construction tax required in this chapter to be paid may be paid at either of the following times, at the option of the developer: 1. Prior to Building Permit. Upon issuance by the City of a building permit for the construction of any residential dwelling unit or upon issuance by the city of a permit to connect to sewer and water lines to service a mobile home lot in a mobile home park. 2. Prior to Final Building Inspection. If the developer chooses to defer payment of the construction tax until final building inspection then prior to issuance of a building permit, the developer shall supply a letter of credit in form acceptable to the City Attorney guaranteeing payment of the scheduled construction tax.
