CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 1292 <br /> <br /> AN ORDINANCE DEFERRING IMPOSITION OF THE CITY'S <br /> RESIDENTIAL CONSTRUCTION TAX UNTIL FINAL INSPECTION <br /> PREAMBLE <br /> <br /> A. The State Legislature has adopted Government Code <br />Section 53077.5 (AB 3314, which is Chapter 685 of 1986 Statutes). <br />AB 3314 takes effect on January 1, 1987 and requires that certain <br />fees and charges cannot be collected until the final building <br />inspection. <br /> B. The City hereby determines that its residential <br />construction tax may fall within the purview of the AB 3314 <br />requirements- <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br />HEREBY ORDAIN AS FOLLOWS: <br /> Section 1: Section 3.24.040 of the Pleasanton Municipal Code is <br /> hereby amended in its entirety to read as follows: <br /> <br /> "3.24.040 Time of payment-Refunds <br /> A. The residential construction tax required in <br /> this chapter to be paid may be paid at either of the <br /> following times, at the option of the developer: <br /> <br /> 1. Prior to Building Permit. <br /> <br /> Upon issuance by the City of a building permit for <br /> the construction of any residential dwelling unit <br /> or upon issuance by the city of a permit to connect <br /> to sewer and water lines to service a mobile home <br /> lot in a mobile home park. <br /> <br /> 2. Prior to Final Building Inspection. <br /> <br /> If the developer chooses to defer payment of the <br /> construction tax until final building inspection <br /> then prior to issuance of a building permit, the <br /> developer shall supply a letter of credit in form <br /> acceptable to the City Attorney guaranteeing <br /> payment of the scheduled construction tax. <br /> <br /> B. Refund <br /> <br /> There shall be a refund of such tax to the person <br /> who paid such in the event that the building permit or <br /> permit to connect to sewer and water lines to service a <br /> <br /> <br />
