Ms. Decker also requested the Commission to make a determination on whether it prefers <br />a wood or masonry retaining wall and if it desired to leave the review of the drainage and <br />grading plan to the Building and Safety Division and the Engineering Department. <br />Chair Blank suggested that a drainage and grading plan be required and that the retaining <br />wall material be subject to the review and approval of the Building and Safety Division. <br />He indicated that he was surprised by the amount of space desired by the applicant <br />between the house and the pool and that he would like to see more of setback; however, <br />he would support the ten -foot rear yard setback especially since the Bessos were <br />amenable to it. He indicated that he agreed with the majority of the Commission with <br />respect to a ten -foot setback for the hot tub. He noted that the decision would not make <br />everyone happy but that this was part of trying to figure out the best way to work through <br />this. <br />Commissioner Pearce moved to recommend approval to the City Council of <br />Case PUD- 99- 01 -05M, subject to the conditions of approval as listed in Exhibit B of <br />the staff report with the modifications that Condition No. 3 include the language for <br />Option 2 regarding reducing the side yard setback from ten feet to five feet and the <br />rear yard setback from 20 feet to 10 feet and the addition of a condition that the <br />applicant submit a drainage and grading plan prior to the issuance of a building <br />permit. <br />Ms. Decker proposed the following language for the new condition as follows: "The <br />applicant shall submit a grading and drainage plan that provides detailed information <br />regarding materials to be used to retain and provide positive drainage, subject to the <br />review and approval of the Director of Planning and Community Development prior to <br />the issuance of a building permit." <br />Commissioner Fox seconded the motion. <br />ROLL CALL VOTE: <br />AYES: Commissioners Blank, Fox, Narum, Olson, and Pearce. <br />NOES: None. <br />ABSTAIN: None. <br />RECUSED: None. <br />ABSENT: None. <br />Resolution No. PC- 2008 -17 recommending approval to the City Council of <br />Case PUD- 99- 01 -05M was entered and adopted as motioned. <br />Ms. Decker noted that as a major modification, this item would automatically come <br />before the City Council and that no appeal was required. <br />PLANNING COMMISSION MINUTES, April 9, 2008 Page 28 of 33 <br />
