PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. PC- 2006 -65 <br />RESOLUTION RECOMMENDING APPROVAL OF A CONDITIONAL USE PERMIT FOR <br />REGENCY CENTERS/HOME DEPOT, AS FILED UNDER CASE PCUP -165 <br />WHEREAS, Regency Centers /Home Depot has applied for a conditional use permit to allow <br />the construction of 193,481 square feet of commercial area, including a Home <br />Depot building supply store and garden center, a Long's Drug's pharmacy with <br />drive - through, and miscellaneous neighborhood retail stores including one <br />drive - through, on an approximately 16 -acre parcel located at the Valley <br />Avenue /Bernal Avenue /Stanley Boulevard intersection, in the Stanley Business <br />Park; and <br />WHEREAS, zoning for the property is PUD -C (Planned Unit Development - Commercial) <br />District; and <br />WHEREAS, at its duly noticed public hearing of December 13, 2006, the Planning <br />Commission considered all public testimony, relevant exhibits, and <br />recommendations of the City staff concerning this application; and <br />WHEREAS, the Planning Commission recommended approval for the Negative Declaration <br />prepared for this project; and <br />WHEREAS, the Planning Commission made the following findings: <br />The proposed location of the conditional use is in accordance with the objectives of the <br />zoning ordinance and the purpose of the district in which the site is located. <br />The site of the proposed uses is located in the Stanley Business Park, which conditionally <br />permits building supply stores and garden centers. The proposed conditionally allowed uses with <br />the permitted commercial uses of the overall development will support the businesses of the <br />nearby Stanley Business Park and would provide a variety of goods and services are available to <br />the business park tenants and to the residents of the nearby neighborhoods. The Home Depot <br />building supply store /garden will potentially reduce the amount of cross -town trips to similar <br />businesses. The conditions of approval proposed for this.project give the City the appropriate <br />controls to ensure that the use does not have any negative impacts on surrounding businesses. <br />The use permit for the building supply store /garden center is, therefore, in accordance with the <br />objectives of the zoning for this district, and this finding can be made. <br />
