Tutoring for more than 40 staff and <br />students at any one time, excluding <br />dance, martial arts, and gymnastics <br />3. With the tentative subdivision /parcel map, the project developer shall set forth the <br />common open space /maintenance areas of the proposed development and <br />maintenance responsibilities. The project developer shall record CC &R's at the time of <br />recordation of the final map, which shall create a property association for the <br />development. The CC &R's shall be subject to the review and approval of the City <br />Attorney prior to recordation of the final map. The property owners association shall be <br />responsible for the maintenance of all private utilities, bio- retention swales, landscape <br />areas, and other common areas /facilities on the project site. The City shall be granted <br />the rights and remedies of the association, but not the obligation, to enforce the <br />maintenance responsibilities of the property owners association. <br />4. The project developer shall show on the tentative subdivision /parcel map application the <br />building setback lines, building outlines including walkways, parking and driveway <br />areas, superimposed on the lots. <br />5. The project developer shall record at the time of recordation of the final map reciprocal <br />access, parking, and utility easements with maintenance and repair responsibilities <br />clearly defined among all (future) parcels unless 'otherwise approved by the Planning <br />Director. <br />6. The project developer shall provide a bond to the City guaranteeing the installation of all <br />perimeter landscaping and all common infrastructure improvements shown on the <br />approved development plan or as otherwise required as part of this development. The <br />project developer shall provide an itemized cost estimate of said improvements, to be <br />submitted with the bond, for the review and approval the Planning Director prior to <br />recordation of the final subdivision map. The Planning Director shall return the bond to <br />the project developer upon acceptance of said improvements. <br />4 <br />
