B. Fees. The applicant shall pay a fee for reviewing and processing the application in <br />accordance with the resolution establishing fees and charges for various municipal <br />services. <br />17.04.070 Public Hearing Required. <br />The City Council shall hold a public hearing prior to a determination to approve or disapprove <br />an application for a condominium conversion project, at which time the City Council shall take <br />testimony concerning the proposed conversion, measures proposed to be taken to meet the <br />requirements of this chapter, and other relevant information. Notice of the public hearing shall <br />be given in the manner required by Section 18.12.040 of this code. In addition, the City shall <br />provide notice within ten (10) days of the hearing to every tenant. <br />17.04.080 Review of Condominium Conversion Application <br />The City Housing Commission shall review the Affordable Housing Proposal in accordance <br />with the Inclusionary Zoning Ordinance. The Planning Commission shall review. as set forth in <br />city code. modifications to building structures. The City Council, following its review of each <br />application, may approve, conditionally approve, or deny a project based on the findings in <br />Section 17.04.090 of this chapter. The City Council may also waive particular requirements of <br />this chapter or any other section of the code if it finds that meeting a particular requirement <br />would cause an undue hardship or if the conversion, despite the failure to meet all the <br />requirements, is consistent with the General Plan, any specific plan policies, and the <br />Inclusionary Zoning Ordinance, and conforms to the purposes of this chapter. In granting <br />approval, the City Council shall ensure that the provisions of this chapter relating to physical <br />standards (Section 17.04.040) tenant provisions (Section 17.04.050) and Inclusionary Zoning <br />Ordinance requirements are implemented in such a manner as to maintain the public health, <br />safety and welfare. <br />17.04.090 Findings <br />The City Council may approve and /or conditionally approve a request for a condominium <br />conversion project when it finds that all of the following apply: <br />1. The condominium conversion project is consistent with the General Plan, including its <br />housing element, and any specific plan policies governing the property; <br />2. The affordable housing plan for the condominium conversion project satisfies the <br />requirements of the Inclusionary Zoning Ordinance and the developer enters into an affordable <br />housing agreement as set forth in the Inclusionary Zoning Ordinance; <br />3. The condominium conversion project meets the conditions in this chapter, including the <br />tenant protection requirements and physical standards; <br />4. The condominium conversion project is appropriate as a condominium conversion project <br />due to its age, condition, including any proposed renovations, and location; <br />Page 7 of 9 <br />
