F. "Multiple -Unit Residential Rental Project" means any residential real property improved with <br />two or more attached or detached dwelling units and where at least one unit is offered for <br />rent. A Multiple -Unit Residential Rental Project does not include a single family residence <br />that has an attached or detached second unit on the same property. <br />G. "Tenant" means any person who resides in a dwelling unit in a multiple -unit residential <br />project whether by month to-month tenancy, lease or other rental agreement. <br />H. "Tenant, elderly" means any tenant who is age sixty-two or older on the date of the notice <br />of intent to offer a unit for sale pursuant to Section 17.04.50 of this Chapter. <br />I. "Tenant, handicapped" means any tenant who meets the definition in Section 50072 of the <br />California Health and Safety Code on the date of the notice of intent to offer a unit for sale <br />pursuant to Section 17.04.050 of this Chapter. <br />J. "Tenant, low income" means any tenant household residing in a dwelling unit on the date of <br />the notice of intent to offer a unit for sale pursuant to Section 17.04.050 of this Chapter with <br />an income less than eighty percent (80 of the Area Median Income for the Oakland <br />Primary Metropolitan Statistical Area adjusted for family size in accordance with adjustment <br />factors adopted and amended from time to time by the United States Department of <br />Housing and Urban Development (HUD). <br />K. "Tenant, very-low income" means any tenant household residing in a dwelling unit on the <br />date of notice of intent to offer a unit for sale pursuant to Section 17.04.050 of this Chapter <br />with an income less than fifty percent (50 of the Area Median Income for the Oakland <br />Primary Metropolitan Statistical Area adjusted for family size in accordance with adjustment <br />factors adopted and amended from time to time by the United States Department of <br />Housing and Urban Development (HUD). <br />17.04.030 Purpose <br />A. In order to provide for the housing needs of all segments of the community, the purposes of <br />this chapter are set forth as follows: <br />1. To minimize or avoid the hardship caused by the displacement of tenants, particularly <br />the elderly, the handicapped, and low- income and very-low income households, following <br />the conversion of their dwelling units; and <br />2. To reduce tenant displacement by encouraging ownership of lower cost residential <br />ownership for existing tenants; and <br />3. To assure compliance with the Inclusionary Zoning Ordinance; and <br />4. To retain diversity of the City's housing inventory and levels of affordability, as required <br />by the General Plan. <br />B. The City Council finds and declares: <br />Page 2 of 9 <br />
