CITY COUNCIL OF THE CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. 02-137 <br /> <br />RESOLUTION VACATING AN EXCESS PORTION OF THE <br />EXISTING VINEYARD AVENUE RIGHT OF WAY <br />ADJACENT TO THE HEINZ PROPERTY (LOT 28 OF THE <br />VINEYARD AVENUE CORRIDOR SPECIFIC PLAN AREA) <br />AND AUTHORIZING THE CITY MANAGER TO EXECUTE <br />A QUITCLAIM DEED FOR THIS EXCESS RIGHT OF WAY <br /> <br />WHEREAS, <br /> <br />in 1970, an additional right of way was dedicated to Alameda County for future <br />widening of the existing Vineyard Avenue adjacent to the Heinz property (Lot 28 <br />of the Vineyard Avenue Corridor Specific Plan); and <br /> <br />WHEREAS, <br /> <br />this widening of Vineyard Avenue did not occur and is not anticipated to occur <br />now that the property has been annexed to the City of Pleasanton and is being <br />developed pursuant to the Vineyard Avenue Corridor Specific Plan adopted by the <br />Pleasanton City Council on June 1, 1999; and <br /> <br />WHEREAS, <br /> <br />this excess Vineyard Avenue right of way to be vacated along the Heinz property <br />is described in the attached Exhibit "A" and depicted on the attached Exhibit "B"; <br />and <br /> <br />WHEREAS, <br /> <br />it is the intention of the City Council to summarily vacate this right of way <br />pursuant to Chapter 4 of Part 3 of Division 9 of the California Streets & Highways <br />Code as this excess right of way has not been used as a street and is not needed for <br />that purpose; the use of this portion of Vineyard Avenue as a vehicular right of <br />way in general has been superseded by relocation; no property access will be <br />terminated by the vacation of this excess right of way; and this excess right of way <br />does not contain any public service easement nor public facilities within it; and <br /> <br />WHEREAS, <br /> <br />the vacation of this excess portion of Vineyard Avenue right of way along the <br />Heinz property is consistent with the City's General Plan and the Vineyard Avenue <br />Corridor Specific Plan; and <br /> <br /> <br />
