CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 1280 <br /> <br /> ORDINANCE APPROVING DEVELOPMENT AGREEMENT BETWEEN THE <br /> CITY OF PLEASANTON AND BERNAL AVENUE ASSOCIATES (KOLL) <br /> <br />WHEREAS, Government Code Sections 65864 through 65869.5 <br /> authorizes cities and counties to enter into binding <br /> development agreements with persons having legal or <br /> equitable interests in real property for the development <br /> of such property; and <br /> <br />WHEREAS, Bernal Avenue Associates has made application to the <br /> City to enter into such an agreement provided for in the <br /> Government Code in conjunction with its application for <br /> approval of a development plan; and <br /> <br />WHEREAS, after public notice, the Planning Commission held a <br /> hearing on September 24, 1986 and recommended approval <br /> of the development agreement as proposed; <br /> <br />THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS <br />FOLLOWS: <br /> <br />Section 1: Finds that the proposed Development Agreement for the <br /> Koll Center Business Park is consistent with the City's <br /> General Plan. <br /> <br />Section 2: Approves the Development Agreement between the City <br /> of Pleasanton and Bernal Avenue Associates (Koll), a <br /> copy of which is attached hereto and incorporated herein <br /> by this reference. <br /> <br /> Section 3: Authorizes the appropriate city officials to execute <br /> the above-referenced agreement. <br /> <br /> Section 4: This ordinance shall be published once within fifteen <br /> (15) days after its adoption in "The Valley Times," a <br /> newspaper of general circulation published in the City <br /> of Pleasanton. <br /> <br /> Section 5: This ordinance shall be effective thirty (30) days <br /> after the date of its final passage and adoption. <br /> <br /> INTRODUCED at a regular meeting of the City Council of the City <br /> of Pleasanton on October 28, 1986. <br /> <br /> <br />
