CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA ORDINANCE NO. 1280 ORDINANCE APPROVING DEVELOPMENT AGREEMENT BETWEEN THE CITY OF PLEASANTON AND BERNAL AVENUE ASSOCIATES (KOLL) WHEREAS, Government Code Sections 65864 through 65869.5 authorizes cities and counties to enter into binding development agreements with persons having legal or equitable interests in real property for the development of such property; and WHEREAS, Bernal Avenue Associates has made application to the City to enter into such an agreement provided for in the Government Code in conjunction with its application for approval of a development plan; and WHEREAS, after public notice, the Planning Commission held a hearing on September 24, 1986 and recommended approval of the development agreement as proposed; THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS FOLLOWS: Section 1: Finds that the proposed Development Agreement for the Koll Center Business Park is consistent with the City's General Plan. Section 2: Approves the Development Agreement between the City of Pleasanton and Bernal Avenue Associates (Koll), a copy of which is attached hereto and incorporated herein by this reference. Section 3: Authorizes the appropriate city officials to execute the above-referenced agreement. Section 4: This ordinance shall be published once within fifteen (15) days after its adoption in "The Valley Times," a newspaper of general circulation published in the City of Pleasanton. Section 5: This ordinance shall be effective thirty (30) days after the date of its final passage and adoption.
