CITY COUNCIL OF THE CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. 02-124 <br /> <br />RESOLUTION CONTINUING A COMPENSATION POLICY <br />FOR MILITARY RESERVISTS ADOPTED BY CITY <br />COUNCIL RESOLUTION NO. 01-115 <br /> <br />WHEREAS, <br /> <br />the City Council of the City of Pleasanton adopted Resolution No. 01-115 on <br />November 6, 2001, establishing a compensation policy for military reservists <br />employed by the Livermore-Pleasanton Fire Depm'tment (LPFD); and <br /> <br />WHEREAS, <br /> <br />a Livermore-Pleasanton Fire Department (LPFD) Fire Captain, Charles (Chuck) <br />Phillips, was activated by the United States Coast Guard (USCG) from <br />September 15, 2001 to September 14, 2002 and has received orders from the <br />United States Coast Guard to continue on active duty for another 365 days through <br />September 30, 2003; and <br /> <br />WHEREAS, <br /> <br />Fire Captain Charles (Chuck) Phillips has formally requested an extension of the <br />compensation policy for another twelve (12) months to cover his second tour of <br />duty; and <br /> <br />WHEREAS, the law provides the flexibility for employers to determine the level of <br /> compensation, if any, beyond the 30 day mandate for full salary. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: <br /> <br />The City of Pleasanton is hereby authorized to continue the compensation policy <br />of providing the difference between the amount of Captain Charles (Chuck) <br />Phillips' military pay and the amount he would have received if working as <br />regularly scheduled with LPFD, including paid benefits, paid time-off accruals and <br />PERS retirement credit for a period extending up to September 30, 2003 per <br />Resolution No. 01-115. <br /> <br /> <br />
