CITY COUNCIL OF THE CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. 02-123 <br /> <br />RESOLUTION INITIATING FORMATION OF <br />UNDERGROUND UTILITY DISTRICT NO. 02-1, FIRST <br />STREET-KOTTINGER STREET, AND SETTING A PUBLIC <br />HEARING <br /> <br />WHEREAS, <br /> <br />Chapter 13.12 of the Pleasanton Municipal Code establishes a procedure for the <br />creation of underground utility districts and require as the initial step in such <br />procedure the holding of a public heating to ascertain whether the public necessity, <br />health, safety or welfare requires the removal of poles, overhead wires and <br />associated overhead structures and the undergrounding of wires and facilities for <br />supplying electric, communication, or similar or associated services in any such <br />district; and <br /> <br />WHEREAS, <br /> <br />it has been recommended that such an underground utility district, hereinafter <br />called District, be formed on First Street from West Angela Street to Stanley <br />Boulevard, and on Kottinger Street from First Street to a point 550 feet west of <br />First Street. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: <br /> <br />A public hearing, as may be cont'mued from time to time, will be held by the City <br />Council on December 17, 2002, at the hour of 7:00 p.m. in the Council Chambers, <br />200 Old Bemal Avenue, Pleasanton, California, to ascertain whether the public <br />necessity, health, safety or welfare requires the removal of poles, overhead wires <br />and associated overhead structures and the underground installation of wires and <br />facilities for supplying electric, commuication or similar or associated services in <br />the District hereinabove described. <br /> <br />Section 2: At such hearing all persons interested shall be given the opportunity to be heard. <br /> <br />Section 3: <br /> <br />The City Clerk shall notify all affected property owners as shown on the last <br />equalized assessment roll and utilities concerned of the time and place of such <br />hearing by mailing a copy of this resolution to such property owners and utilities <br />concerned a least ten (10) days prior to the date thereof. <br /> <br /> <br />
