CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. 02-123 RESOLUTION INITIATING FORMATION OF UNDERGROUND UTILITY DISTRICT NO. 02-1, FIRST STREET-KOTTINGER STREET, AND SETTING A PUBLIC HEARING WHEREAS, Chapter 13.12 of the Pleasanton Municipal Code establishes a procedure for the creation of underground utility districts and require as the initial step in such procedure the holding of a public heating to ascertain whether the public necessity, health, safety or welfare requires the removal of poles, overhead wires and associated overhead structures and the undergrounding of wires and facilities for supplying electric, communication, or similar or associated services in any such district; and WHEREAS, it has been recommended that such an underground utility district, hereinafter called District, be formed on First Street from West Angela Street to Stanley Boulevard, and on Kottinger Street from First Street to a point 550 feet west of First Street. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1: A public hearing, as may be cont'mued from time to time, will be held by the City Council on December 17, 2002, at the hour of 7:00 p.m. in the Council Chambers, 200 Old Bemal Avenue, Pleasanton, California, to ascertain whether the public necessity, health, safety or welfare requires the removal of poles, overhead wires and associated overhead structures and the underground installation of wires and facilities for supplying electric, commuication or similar or associated services in the District hereinabove described. Section 2: At such hearing all persons interested shall be given the opportunity to be heard. Section 3: The City Clerk shall notify all affected property owners as shown on the last equalized assessment roll and utilities concerned of the time and place of such hearing by mailing a copy of this resolution to such property owners and utilities concerned a least ten (10) days prior to the date thereof.
