CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA ORDINANCE NO. 1273 ORDINANCE RELATING TO REGULATION OF NOISE CREATED BY SKATEBOARD RAMPS WHEREAS, the City Council has received more information concerning construction of skateboard ramps in residential areas from public comments and hearings and staff; and WHEREAS, the City Council desires to control the noise impacts of skateboard ramps by limiting time of daily operation, type of construction, and related spillover effects; THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS FOLLOWS: Section 1: Chapter 9.04 entitled "NOISE REGULATIONS" is hereby amended by adding to the Pleasanton Municipal Code (PMC) to read as follows: 9.04.075 Skateboard Ramps The City Council does find and declare as follows: A. Skateboard ramps (as defined in Title 18 PMC) are a source of noise which must be regulated; and B. Skateboard ramps, if built to regulations consistent with safety and noise dampening standards, will be permitted; and C. The City Planning Department in conjunction with Building Department shall be authorized to promulgate regulations consistent with purposes of safety and noise considerations of the Pleasanton Municipal Code, subject to approval by City Council; and D. If any skateboard ramp complies with the promulgated regulations concerning skateboard ramp construction, skateboard ramps will be permitted to be used during specified hours, except on Sundays when use of skateboard ramps shall be prohibited, and exempt from Chapter 9.04, Noise Regulations, subject to the City's Zoning Ordinance Section 18.120.000, NONCONFORMING USES. 9.04.076 Skateboard Ramp - Time of Operation If skateboard ramps are built to regulations specified in Section 9.04.075 (C), skateboard ramps shall be exempt from noise regulation ordinance Sections 9.04.030, 9.04.040, and 9.04.060A of this chapter and - 1 -
