FIRST AMENDMENT TO DEVELOPMENT AGREEMENT <br /> This First Amendment to Development Agreement is entered into this 15th day of <br /> October 2009 by the City of Pleasanton "City and Kenneth R. Chrisman and Pamela L. <br /> Chrisman "the Chrismans"). <br /> Whereas, the City and the Chrismans entered into a Development Agreement <br /> effective September 23, 2002 with an expiration date of September 23, 2012; and <br /> Whereas, the economic climate is very challenging and the Chrismans have <br /> requested a 5 -year extension of the Development Agreement; and <br /> Whereas, the Vineyard Avenue Corridor Specific Plan states that any property <br /> owner who has not filed a final subdivision map within 15 years from the date of the <br /> Specific Plan's adoption by the City Council will not be obligated to pay the Specific <br /> Plan Preparation Fee. (See Vineyard Avenue Corridor Specific Plan, page 109, Section <br /> VIII(B)(6) Specific Plan Preparation Fee.); and <br /> Whereas, the Chrismans have offered to pay the Specific Plan Preparation Fee to <br /> the City at the time their final map is submitted for approval notwithstanding the <br /> provisions of the Specific Plan; and <br /> Whereas, an ordinance was adopted by the City Council at a regular meeting on <br /> September 15, 2009, and became effective October 15, 2009, thereby approving the First <br /> Amendment to the Development Agreement and extending the term by 5 years or to <br /> September 23, 2017. <br /> Now, therefore, the parties agree as follows: <br /> 1. Section II of the Development Agreement is amended to extend the term <br /> until September 23, 2017. <br /> 2. The Chrismans shall pay the Specific Plan Preparation Fee to the City at <br /> the time their final map is submitted for approval. <br /> 3. This First Amendment to Development Agreement shall be recorded with <br /> the County of Alameda Recorder's Office. <br /> 4. All other terms and conditions of the Development Agreement shall remain in <br /> full force and effect. <br /> 1 <br />
