ORDINANCE NO. 1996 <br /> AN ORDINANCE APPROVING AN AMENDMENT TO THE DEVELOPMENT <br /> AGREEMENT WITH KENNETH PAMELA CHRISMAN EXTENDING THE TERM OF <br /> THE DEVELOPMENT AGREEMENT BY FIVE YEARS <br /> WHEREAS, Government Code Section 65865 through 65869.5 authorizes cities and <br /> counties to enter into binding development agreements with persons having legal or equitable <br /> interests in real property for the development of such property; and <br /> WHEREAS, in 2002, the City of Pleasanton adopted Ordinance No. 1855 approving a <br /> development agreement between the City and Kenneth Pamela Chrisman "the Chrismans <br /> regarding their property located on Old Vineyard Avenue; and <br /> WHEREAS, in August 2009, the Chrismans applied to the City for an amendment to the <br /> development agreement that would extend the term of the agreement for an additional five <br /> years; and <br /> WHEREAS, after public notice, on August 12, 2009, the Planning Commission held a <br /> hearing and recommended approval of the amendment to the Development Agreement; and <br /> WHEREAS, at its meeting of September 15, 2009, the City Council reviewed the staff <br /> report from the Director of Community Development together with a copy of the staff report to <br /> the Planning Commission on this matter; and <br /> WHEREAS, on September 15, 2009, a duly- noticed public hearing was held by the City <br /> Council, at which time the applicant and members of the public were offered an opportunity to <br /> present evidence regarding the amendment to the development agreement; and <br /> WHEREAS, minor changes to and use regulations such as this are categorically exempt <br /> from CEQA; and <br /> WHEREAS, the City Council finds that the amendment to the Development Agreement <br /> is consistent with the City's General Plan. <br /> NOW,THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br /> HEREBY ORDAIN AS FOLLOWS: <br /> SECTION 1. Approves the First Amendment to the Development Agreement, a draft <br /> copy of which is attached hereto and incorporated herein by reference, the final form of which is <br /> to be approved by the City Attorney. <br /> SECTION 2. Authorizes the appropriate City officials to execute the above referenced <br /> First Amendment when approved as to form by the City Attorney and directs the City Clerk to <br /> record the document as provided in Section 65868.5 of the Government Code. <br /> SECTION 3. A summary of this ordinance shall be published once within 15 days after <br /> its adoption in the "Valley Times a newspaper of general circulation published in the City of <br /> Pleasanton, and the complete ordinance shall be posted for 15 days in the City Clerk's office <br /> within 15 days after its adoption. <br />
