02 <br /> ORDINANCE NO. 1997 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> AMENDING PLEASANTON MUNICIPAL CODE CHAPTER 1.12 (GENERAL <br /> PENALTY) AND CHAPTER 11.38 (RESIDENTIAL PERMIT PARKING ZONE) <br /> WHEREAS, Chapter 1.12 is the general penalty chapter of the Municipal Code; and <br /> WHEREAS, Section 1.12.020 (Infractions) of the Municipal Code provides that any <br /> person who violates designated chapters of the Municipal Code is guilty of an infraction, <br /> punishable by enumerated fines; and <br /> WHEREAS, section 11.38.120 provides that a violation of Chapter 11.38 (residential <br /> permit parking zone) shall be deemed an infraction and punishable by a fine of $25.00; and <br /> WHEREAS, although section 1.12.020 (Infractions) designates as infractions several <br /> chapters of Title 11 (Vehicles and Traffic) of the Municipal Code, Chapter 11.38 (Residential <br /> Parking Permit Zone) is not one of the designated chapters; and <br /> WHEREAS, it is desirable to list all infractions in section 1.12.020 (Infractions); and <br /> WHEREAS, it is desirable to include the penalty for a violation of Chapter 11.38 <br /> (Residential Permit Parking Zone) along with other penalties for violation of Title 11 (Vehicles <br /> and Traffic) in the Master Fee Schedule, Resolution 92 -100, dated May 19, 1992. <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br /> HEREBY ORDAIN AS FOLLOWS: <br /> Section 1. Amends Municipal Code Chapter 1.12.020 (General Penalty) to read as <br /> follows: <br /> Section 1.12.020 (A), no changes. <br /> Section 1.12.020 (B), Violations of the following sections are designated punishable as <br /> infractions: <br /> To the list, add Chapter 11.38, residential permit parking zone. <br /> To the list, add Chapter 11.48, commercial vehicle regulations. <br /> To the list, add Chapter 11.68, miscellaneous driving rules. <br /> Section 2. Amends Municipal Code §11.38.120 to read as follows: <br /> Section 11.38.120 (Penalty). <br /> A violation of this chapter shall be punishable as an infraction as provided in section <br /> 1.12.020 of this code. <br /> Section 3. A summary of this ordinance shall be published once within fifteen (15) <br /> days after its adoption in "The Valley Times," a newspaper of general circulation published in <br /> the City of Pleasanton, and the complete ordinance shall be posted for fifteen (15) days in the <br /> City Clerk's office within fifteen (15) days after its adoption. <br /> Section 4. This ordinance shall be effective thirty (30) days after its passage and <br /> adoption. <br />
