CITY COUNCIL OF THE CITY OF pLEASANTON ALAMEDA COUNTY, CALIFORNIA ORDINANCE NO. 1247 ORDINANCE ApPROVING DEVELOPMENT AGREEMENT BETWEEN THE CITY OF pLEASANTON AND THE pRUDENTIAL INSURANCE COMPANY OF AMERICA FOR HACIENDA BUSINESS PARK PHASE II WHEREAS, Government Code Section 65864 through Section 65869.5 authorizes cities and counties to enter into binding development agreements with persons having legal or equitable interests in real property for the development of such property; and WHEREAS, The prudential Insurance Company of America has made application to the City to enter into such an agreement provided for in the Government Code in conjunction with its application for approval of a development plan; and WHEREAS, the EIR certified as adequate for the project as a whole encompassed the effects of the project as provided for in the development agreement; and WHEREAS, after public notice, the planning Commission held a hearing on February 12, 1986 and recommended approval of the development agreement as proposed; THE CITY COUNCIL OF THE CITY OF pLEASANTON DOES HEREBY ORDAIN AS FOLLOWS: Section 1: Finds that the proposed Development Agreement for Hacienda Business Park Phase II is consistent with the City's General Plan. Section 2: Approves the Development Agreement between the City of pleasanton and The prudential Insurance Company of America, a copy of which can be reviewed at the City Attorney's office, 200 Old Bernal Avenue, pleasanton, California- Section 3: Authorizes the appropriate city officials to execute the above-referenced agreement- Section 4: This ordinance shall be published once within fifteen (15) days after its adoption in "The Tri-Valley Herald," a newspaper of general circulation published in the City of pleasanton. Sections5: This ordinance shall be effective thirty (30) days after the date of its final passage and adoption- iNTRODUCED at a regular meeting of the City Council of the City of pleasanton on March 4, 1986.
