WHEREAS, <br /> <br />WHEREAS, <br /> <br />the City Council hereby determines that the proposed ordinance, <br />presented herewith, establishes requirements which are of <br />equivalent enforcement procedures as allowed by the applicable <br />provisions of Title 25 California Code of Regulations, (25 C.C.R.), <br />Division 1, Chapter 1, Subchapter 1, Article 6, §52 for the City of <br />Pleasanton as set forth in Section 20.32, Dangerous Buildings; and <br /> <br />the City Council finds that each of the aforementioned changes <br />which is set forth in this ordinance is reasonably necessary, and <br />said Council fmther finds that the following factors support the <br />local necessity for the aforementioned proposed changes; <br /> <br />1. As to Sections 20.08.025 (smoke detectors) and <br />20.08.030 (spark arresters) of the Pleasanton Municipal <br />Code. Sparks can cause fire to start on wood product roofs <br />of existing homes and since many of the existing homes are <br />not currently required to have smoke detectors, the <br />potential loss of life is greatly increased. Therefore, the <br />smoke detector and spark arrester requirements will <br />decrease potential loss of life. <br /> <br />2. As to Sections 20.08.045 (fire extinguishing systems), <br />the National Fire Protection Association (NFPA) is a <br />nationally recognized organization of building, fire and <br />insurance industry representatives. NFPA 13-D is a <br />minimum residential fire sprinkler specification, which has <br />been amended. Because NFPA 13-D does not require that <br />sprinkler heads be installed in areas of ancillary residential <br />use (attics, garages, etc.) and without worry of lines <br />freezing in these areas, this national standard inadequately <br />addresses the needs of the City of Pleasanton. A more <br />appropriate local amendment to the National Standard to <br />provide fire protection in areas of homes is the City of <br />Pleasanton Standard 9-3. <br /> <br />3. As to Sections 20.08.045 (fire extinguishing systems), <br />20.08.048 (automatic fire extinguishing systems), <br />20.48.049 (Pleasanton sprinkler standard), 20.08.050 (roof <br />coverings), the City of Pleasanton requires additional built- <br />in automatic fire protection systems to address possible <br />delay in response due to the local conditions set forth <br />above. <br /> <br />4 <br /> <br /> <br />
