PCEA dues. In addition, in order to meet certain accounting deadlines, all payroll <br /> changes connected with the deduction of said PCEA dues must be made by the <br /> fifteenth (15th) of the preceding month. <br /> The PCEA shall indemnify, defend, and hold the City harmless against any and <br /> all claims, demands, suits, proceedings or court orders, or any other liability that <br /> may arise out of or by reason of action taken or not taken by the City for the <br /> purpose of complying with any of the provisions of this check -off agreement. In <br /> addition, the PCEA shall refund to the City any amounts paid to it in error upon <br /> presentation of supporting evidence. <br /> The PCEA for which dues are deducted may be required to pay upon the written <br /> demand of the City a service charge of five cents (.05) per name per month for <br /> each employee paying such dues, but in no event more than five percent (5 %) of <br /> the dues. <br /> The employee's authorization request shall be in the following terms: <br /> Date: <br /> "You are hereby authorized and requested to deduct from wages due me (and <br /> payable on every other regular pay day) such amount as which will total the <br /> amount of my PCEA dues as reported to you by the President of PCEA and to <br /> make such deductions for each and every succeeding month unless and until I <br /> revoke this assignment in writing. You are hereby authorized and you are to pay <br /> the total amount deducted each month to PCEA. This assignment is voluntary. <br /> Signature <br /> 2.2 Maintenance of Membership <br /> All employees in classifications listed in Section 1.0, who are members of the <br /> Association, tendering periodic dues thirty (30) days after the City Council of the <br /> City of Pleasanton approved this Memorandum of Understanding and all <br /> employees in the aforementioned unit who thereafter become members of the <br /> Association shall, as a condition of employment, pay dues to the Association for <br /> the duration of this Memorandum of Understanding, and each year thereafter. <br /> During the term of this agreement, any employee who is a member of the <br /> Association shall have the right to withdraw from the Association and discontinue <br /> dues deduction on every even year during the month of September only. Said <br /> withdrawal shall be communicated by the employee in writing to the President, <br /> Vice - President or Secretary/Treasurer. It will then be forwarded to the Director <br /> of Finance and processed through the payroll system. An employee who is <br /> subsequently employed in a position outside of the unit represented by the <br /> Association shall not be required to pay dues to the Association. <br /> -4 - <br />
