Section 36. Past Practices and Existing Memorandum of Understanding <br /> 36.1 Continuance of working conditions and practices not specifically authorized by <br /> ordinance or by resolution of the City Council is not guaranteed by this <br /> Memorandum of Understanding. <br /> 36.2 This Memorandum of Understanding shall supersede all existing Memoranda of <br /> Understanding between the City and the PCEA. <br /> 36.3 This Memorandum of Understanding represents a complete and final <br /> understanding and agreement on all issues negotiated between the city <br /> representatives and the Association's representatives. <br /> Section 37. Miscellaneous <br /> 37.1 Printing of MOUs <br /> The City shall print 200 copies of this Memorandum of Understanding in booklet <br /> form. The City and the PCEA shall share the cost of the printing. <br /> 37.2 Exercise Facilities <br /> All PCEA members shall have access to exercise facilities located in the City <br /> Police and Fire Departments on an availability basis. The City shall provide <br /> exercise facilities at the City Operations Service Center. Employees agree to sign <br /> a hold harmless waiver prior to utilizing any City exercise facilities. PCEA <br /> members shall have access to City sports facilities on the fee and availability <br /> schedule established for City residents. <br /> Consistent with State law, employees from departments other than Police <br /> requesting access to the exercise facility located in the Police Department will be <br /> required to undergo a comprehensive background investigation prior to receiving <br /> approval from the Police Chief to use this facility. <br /> 37.3 Temporary Employee Practices <br /> If anticipated changes to the City's temporary employment policy affects PCEA <br /> bargaining unit work, the City will discuss said policy changes with <br /> representatives of the PCEA. <br /> 37.4 Flexible Spending Accounts <br /> The City shall implement a flexible spending account for PCEA employees in <br /> accordance with the provisions of IRS Code 125, no later than July 1, 1997. <br /> Expenses included in the program shall include eligible child care and medical <br /> expenses. Any monthly administrative fee charged by the plan administrator shall <br /> be paid by the participating employee. <br /> -38 - <br />
